An opposition lawmaker asked the Supreme Court (SC) on Monday to order the "immediate" exhumation of whatever was buried as the "mortal remains" of former President Ferdinand Marcos at the Libingan ng mga Bayani.

In a motion, Albay Rep. Edcel Lagman called for the exhumation in light of the unannounced burial of the late strongman at the heroes' cemetery away from the public eye last Friday.

Digging up Marcos' "remains" is justified, Lagman said, because the SC decision on the burial has not yet attained finality and so as not to render the motion for reconsideration the petitioners intend to file moot and academic.

"The exhumation is also to effectively censure and discipline the public respondents and the Marcoses for their contumacious disrespect against the Honorable Supreme Court and its processes, even as the premature and surreptitious burial revealed in bold relief the despicable chicanery of the Marcoses which is an affront against the Filipino nation and the Honorable Supreme Court itself," the motion read.

Should the SC allow the exhumation, Lagman proposed a forensic examination in order to determine with certainty that the “mortal remains” of Marcos, not any other artifact or a wax replica of him, were interred at the Libingan ng mga Bayani.

"Verily, the controversial majority decision of the Supreme Court directed the burial of the 'mortal remains' of the late dictator Marcos in the Libingan ng mga Bayani. However, with the inordinate haste and stealthy circumstances which shrouded the interment, there is no certainty as to what was actually buried in the LNMB," the motion stated.

Lagman also notified the Court of his option to file a a petition for contempt against the responsible members of the Marcos family, military and police officials and personnel who "conspired and facilitated the premature and clandestine" interment.

Earlier in the day, petitioners former Bayan Muna Representatives Neri Colmenares and Satur Ocampo urged the high court to cite the Marcos' heirs and military officials involved in contempt for proceeding with the burial.

Anti-Marcos groups condemned what they called a "sneaky" move by the Marcos family and the government, claiming the burial was orchestrated to jump the gun on protests and possible reversal or deferral of the SC decision.
