In a decision dated February 10, the CA 6th division said De Lima failed to show enough proof that she will suffer "irreparable injury" if the CA will not release a temporary restraining order TRO stopping the DOJ from rendering its decision. <br /><br />
The Court has directed the DOJ and the senator to reply to the resolution within 10 days. Associate Justices Romeo Barza and Edwin Sorongon concurred in the decision.<br /><br />

The resolution penned by Associate Justice Nina Antonio Valenzuela stated that De Lima merely cited allegations in her petition instead of evidence that would be the basis for the issuance of the halt order. <br /><br />

The senator earlier filed with the DOJ a motion for inhibition seeking to stop the panel of prosecutors in deciding her case. She failed to submit her counter-affidavit as she insisted that the five-man panel led by Senior Assistant State Prosecutor Peter Ong resolve first her motion before rendering its judgement in her cases.<br /><br />

Justice Secretary Vitaliano Aguirre II said in an interview last Friday that the DOJ will release its resolution this week.<br /><br />

The panel, however, refused De Lima's motion. This prompted her to seek the appellate court's intervention. De Lima is facing complaints for indirect bribery, violation of the Anti-Graft Law and violation of the Dangerous Drugs Act filed by the National Bureau of Investigation, its former deputy directors Reynaldo Esmeralda and Ruel Lasala, the Volunteers Against Crime and Corruption and high value inmate Jaybee Sebastian.

<br />Even Interior Secretary Mike Sueno said that he is ready to be replaced if that would be the decision of President Rodrigo Duterte.<div>
<br />She issued the comment amid an online report that Marcos, who narrowly lost the vice presidency in the May 2016 polls, would take over as Interior secretary after the one-year appointment ban for losing candidates.<br /><br />“We serve at the pleasure of the President. It is within his power, wisdom and discretion to appoint members of his Cabinet,” Sueno said in a press statement on Wednesday.<br /><br />“With the information being floated about the change at the helm of the DILG, I take no offense whatsoever. It is business as usual for me as I dispense my duties and functions with the blessings of President Duterte,” he added.<br /><br />Robredo said such talk “has been there as early as the inauguration.” In the television interview.<br /><br />“It’s always the President’s privilege who to appoint in his Cabinet, but my concern here is that the Marcoses have not paid for what they did to the country,” she said.<br /><br />“There have been several decisions already asking them to pay back whatever they got from the government, whatever they got from the people. But these judgments have not been satisfied yet,” she added.<br /><br />“And now he’s aiming for a Cabinet position and for me, that’s scary in the sense that he will be given an opportunity to do what they did,” Robredo went on.<br /><br />GMA News Online has sought comment from the Marcos camp but has yet to receive a reply as of posting time.<br /><br />The Marcos family is accused of human rights abuses and amassing government funds during the term of its patriarch, the late President Ferdinand Marcos.<br /><br />The PCGG an agency formed to recover the ill-gotten wealth, said late last year that there are more than 200 pending cases on the estimated $10-billion loot. This includes decades-old cases over Swiss accounts, properties and assets, jewelry sets, and artworks.

More than 6,000 people have died since Duterte took office seven months ago and ordered an unprecedented crime war that has drawn global criticism for alleged human rights abuses, but is popular with many in the mainly Catholic nation. The three-hour rally was organized to oppose the revival of the death penalty by the Congress as well as the killings of drug users and drug pushers in the so-called war on drugs by President Rodrigo Duterte. <br /><br />

Police have estimated the crowd in Manila's Rizal Park to be at 10,000. Villegas urged the Filipinos Catholics to never live in terror, even in the face of violence and looming attempts to reinstate the capital punishment. "The sun will soon rise. There will be hope. Never be afraid of darkness. Never live in fear," said Villegas. <br /><br />

The Walk for Life, which is led by the Council of the Laity, was organized after the Catholic Church expressed alarm over the killings of more than 7,000 people so far since Duterte assumed office June 30 of last year.

"We cannot teach that killing is wrong by killing those who kill. It also increases the number of killers," he added. Manila Archbishop Luis Antonio Cardinal Tagle called on the Filipino people to help save the lives of those who are facing imminent danger. "While we are here, we have to save many lives. Save lives," Tagle said. "Save the lives of those who are at risk. We can save their lives when we show concern and love." <br />

Villegas said the public should have the courage to fight against violence. "Let us face those who threaten us and show our inner strength… They cannot scare us because our faith in God is stronger," he said.<br />

De Lima, who has repeatedly insisted the charges against her are trumped up to silence her and intimidate other Duterte critics, said she attended Saturday's event as a show of solidarity.<br />

"For as long as I can, I will continue to fight. They cannot silence me," De Lima, who is expecting to be arrested in the coming days, told AFP.

First stop, I have always stood by my statement. She is NOT guilty of kidnapping and illegally detaining Luy. I can bet my reputation and one piece of my set of balls on that. I need the other one for aesthetic purpose. If I will explain to you kung bakit wala siyang kasalanan sa pagkidnap kay Benhur, libro ang kailangan kong gawin. It was a made-up criminal prosecution that the past administration did to make sure she is detained so she can talk about the pork barrel scam.

As for the pork barrel scam cases. I will only talk about the general contents of her affidavit that was released to the public by then DOJ Secretary de Lima and Senator Guingona against our wishes. But this I can say with dignity. Hindi po si Duterte ang nasisira sa laman ng affidavit ni Napoles. <br /><br />

Kaya nga siya hindi ginawang state witness dahil malalaking tao sa LP ang andun sa affidavit na yun. Sino ba ang common factor na sinasabing utak sa both PDAF and DAP? Kayo na po ang magbigay ng pangalan. Duterte is not corrupt. I am not corrupt. I could easily be in government to be corrupt but it is not my style. <br /><br />

The only reason people against Duterte are against letting Napoles out and giving her an opportunity to tell her story is this: MADAMING DILAW ANG MATATAMAAN. <br /><br />

And you can quote me on that.

Presidential daughter and Davao City Mayor Sara Duterte on Thursday said she will give P121 million to the public if Senator Antonio Trillanes IV can show where that money is and if he can prove that it is illegal.<br /><br />

"If Trillanes can show where my alleged Php 121 million is right now and how it became illegal, kunin natin at ibigay ko sa inyo lahat," she said in a statement.<br /><br />

Trillanes earlier revived the issue of President Rodrigo Duterte's bank accounts, which he said amounted to P2 billion, in an attempt to disprove that the chief executive is not poor. He also released details of alleged bank accounts of Duterte's family.

TRILLANES MULING BINUHAY ANG ISYU NG UMANO'Y SECRET BANK ACCOUNT NI DUTERTE

MANILA, Philippines — Sen. Antonio Trillanes IV on Thursday revived allegations of undeclared wealth that he raised against President Rodrigo Duterte during the election campaign, saying he will resign if proven wrong. <br /><br />

"Kung mali ako, ako ay mag re-resign dito sa Senado," Trillanes said in a phone interview with DZMM. He claims to have copies of documents that he said show details of bank accounts held by the Duterte family. <br /><br />

Trillanes said that money in President Duterte's bank account reached about P2.4 billion from 2006 to 2015. He said the money came from illegal activities.

Trillanes then called on Duterte supporters to persuade the president to release records of his bank transactions. <br /><br />

Chief presidential legal adviser Salvador Panelo meanwhile, said the supposed billions in Duterte's accounts are an old story and that Trillanes is just looking for publicity. <br /><br />

"Noon, sinabi na ng BPI na fake 'yun," Panelo said. <br /><br />

The Bank of the Philippine Islands said in May 2016 that documents that Trillanes showed then did not come from the bank. The Anti-Money Laundering Council and Bangko sentral ng Pilipinas also denied any involvement in the leak of supposed bank information.

"Hindi naman nilabas ng AMLC, so ibig sabihin, hindi totoo," Panelo said. <br /><br />

He added that Trillanes should just resign and not wait for his allegations to be proven wrong. <br /><br />

Trillanes however said that while the issue is old, it has not yet been addressed.

A Senate bill proposed by Senator Risa Hontiveros seeks to penalize street harassment, such as cat-calling and wolf-whistling.<br /><br />

Senate Bill No. 1326 or the proposed Safe Streets and Public Spaces Act defines harassment as “unwanted comments, gestures, and actions forced on a person in a public space without their consent and is directed at them.”<br /><br />

“Despite the fact that street harassment is a daily reality for an overwhelming majority of Filipinas and LGBTs, there are no clear-cut laws that specifically address this malaise,” Hontiveros said.<br /><br />

Light violations, such as unwanted cursing, wolf-whistling, cat-calling, leering, sexist and homophobic or transphobic slurs, shall be penalized with a fine of up to P3,000 and arrest of up to 30 days.<br /><br />

First offenders will also be required to undergo eight hours inclusive of a Gender Sensitivity Seminar to be conducted by the Philippine National Police (PNP).<br /><br />

Medium violations, meanwhile, include making offensive body gestures at someone and exposing private parts for sexual gratification of the perpetrator. Those violating such will be penalized with a fine of up to P5,000 and imprisonment of up to six months for repeated offenses.<br /><br />

Stalking as well as light and medium violations accompanied by touching, pinching and brushing against the body of a person may be fined up to P10,000 and imprisoned up to six months.<br /><br />

The Metro Manila Development Authority for Metro Manila and the local units of the PNP for other provinces shall deputize its enforcers to be Anti-Sexual Harassment Enforcers (A-SHE).<br /><br />

A-SHEs may immediately apprehend the offender, and immediately impose the fine or issue orders for community service.

MANILA, Philippines – A neophyte senator on Monday, August 8, hit President Rodrigo Duterte for standing firm on his decision to give the late strongman Ferdinand Marcos a hero's burial while publicly condemning oligarchs for ruining the nation. <br /><br />

“For someone who publicly disapproves of oligarchs, President Duterte’s decision to give the late dictator Ferdinand Marcos a hero’s burial is the height of contradiction,” Senator Risa Hontiveros said in a statement.<br /><br />

It does not make sense for Duterte to honor the late dictator, who created the crony system in the first place, Hontiveros said.<br /><br />

“President Duterte cannot end the run of oligarchs in the country by honoring the very man who created a crony oligarchy during Martial Law,” she added.<br /><br />

Duterte earlier singled out Filipino tycoon Roberto Ongpin as an example of the oligarchs his administration wants to do away with.<br /><br />

The President described Ongpin as a businessman close to people in power and implied he used his political influence to strengthen his businesses. Ongpin, Marcos' close friend, served as his trade secretary.<br /><br />

"Malakas kay Marcos, malakas siya and successful. [During the time of] Ramos, he was a hanger-on (The plan is to destroy the oligarchs that are embedded in government. I'll give you an example, publicly – Ongpin, Roberto)," Duterte said in front of election volunteers in Malacañang Palace on August 3.<br /><br />

Marcos unfit for hero’s burial<br /><br />

Hontiveros filed Senate Resolution 86 expressing the chamber’s opposition to a hero’s burial for the late dictator.<br /><br />

“Former president Marcos should not be allowed to be buried at the Libingan ng mga Bayani, given findings of crimes involving moral turpitude as well as the human rights violations that occurred during his administration,” said the resolution.<br /><br />

She said allowing the former president to be buried at the cemetery will only further divide the nation and not heal it, as Duterte had argued.<br /><br />

“Allowing the former president to be buried at the Libingan will only cause further divisiveness and reopen old wounds, especially as the country is also in the process of providing reparations to Martial Law victims,” the resolution said.<br /><br />

Republic Act 10368 or the Human Rights Victims Reparation and Recognition Act of 2013 allocates some P10 billion – sourced mainly from the Marcoses' deposits in Swiss banks – to about 10,000 human rights victims during the martial law. <br /><br />

Other senators – even Duterte’s staunchest allies in the chamber – have strongly opposed Duterte’s decision to allow Marcos to be buried at the hero’s cemetery. – Rappler.com
