IMBENTO? De Lima got P8M from Kerwin Espinosa - cop chief

MANILA - In front of Senator Leila de Lima, a police official recounted Thursday how the lawmaker allegedly accepted P8 million from suspected drug kingpin Rolando "Kerwin" Espinosa, Jr. <br /><br />
Albuera town police chief Jovie Espenido of Leyte was initially hesitant to name the personalities connected to Espinosa's alleged narcotics ring who were identified in the affidavit of his slain father, Albuera Mayor Rolando Espinosa, Sr. <br /><br />
But De Lima herself prodded Espenido to divulge his knowledge of the drug ring, saying "It is previously announced already because certain media items have already identified certain names. I don't mind that you disclose it because I know that my name is in the number one list, if we are to believe in the pronouncement of [Justice] Secretary Aguirre." <br /><br />
Espenido then told senators that the mayor, his wife and four other children had claimed they witnessed De Lima's first meeting with Kerwin at Burnham Park in Baguio City. <br /><br />
The Espinosas even took a photo with the lawmaker, he said. <br /><br />
But Senator Panfilo "Ping" Lacson, who presided over the hearing as chair of the Public Order and Illegal Drugs Committee, pointed out that it is not uncommon for politicians to have their photos taken with the public. <br /><br />
"Sanay na sanay kami na lalakad lang kami d'yan, may magpa-picture. Hindi kaya ganoon ang nangyari kay Senator De Lima na nagkita sila sa Burnham, nagkataong nasa Baguio si Senator De Lima at nagpa-picture ngayon sina Kerwin?" he argued. <br /><br />
Espenido replied that police investigators did not rely solely on the photo, but also on an affidavit executed by another son of the mayor, Kevin, who claimed he delivered P8 million to De Lima at Dampa Restaurant in Pasay. <br /><br />
"Sa affidavit ni Kevin, 'yung anak, s'ya na ang nagsalaysay ngayon, P8 million ang binigay noong first na magkita sila," the police chief said. (In the affidavit of Kevin, the mayor's son, he said he gave P8 million to De Lima during their first meeting.)<br /><br />
He added that De Lima name was included in the Espinosa patriarch's blue and pink books that allegedly contained the names of individuals in their drug payola. <br /><br />

De Lima, for her part, dismissed her alleged meetings with the Espinosas as mere fabrications. <br /><br />
"Ang gagaling ng mga nag-imbento ng mga storya na iyan ha. Nire-research talaga nila na si Senator De Lima, 'pag pumunta sa Baguio, lalo na noong campaign period, dalawang beses pumunta sa Burnham. Itong Dampa na ito, mga a few times ay kumakain talaga doon si Senator De Lima," she scoffed. <br /><br />
"Ang gagaling mag-research, ang gagaling din magdagdag at mag-imbento ng istorya." <br /><br />
(Those who invented those stories are really good. They did their research that Senator De Lima, whenever she went to Baguio especially during the campaign period, went twice to Burnham. Senator De Lima has also dined a few times at this Dampa. They are good at research, and exaggerating and fabricating stories.)

Philippine National Police chief Director General Ronald dela Rosa welcomed Friday the move of the Office of the Ombudsman to have him probed for his all-expense paid trip to Las Vegas courtesy of Senator Manny Pacquiao during the latter’s fight there.<br /><br />
“Sige lang imbestigahan ako,” Dela Rosa told reporters in Davao City before flying back to Manila. He was part of President Rodrigo Duterte's delegation to Malaysia that returned to the country before dawn Friday.<br /><br />
“Makulong ako dahil sa imbitasyon? Tignan natin,” he added.<br /><br />
The Office of the Ombudsman said Thursday it is investigating the possible liability of Dela Rosa.<br /><br />
It said this will be a simple investigation, not a fact-finding one, for possible violation of Republic Act No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees) and Presidential Decree No. 46 (Making it punishable for public officials and employees to receive, and for private persons to give, gifts on any occasion, including Christmas).<br /><br />
It added both Pacquiao and Dela Rosa admitted that the boxing champ and senator paid for the air fare and hotel expenses of the PNP chief and his family.<br /><br />
The Office of the Ombudsman will ask both Pacquiao and Dela Rosa to submit statements and receipts regarding the Las Vegas trip.

‘Nothing wrong’<br /><br />
The PNP chief believes he did nothing wrong as he did not use public funds for his and his family’s trip to Las Vegas last week.<br /><br />
“Ang importante hindi (ako) nagkurakot ng kwarta,” he said in a mix of Bisaya and Tagalog.<br /><br />
He earlier admitted that Pacquiao invited him to watch his fight against Jessie Vargas.<br /><br />
Interior and Local Government Secretary Mike Sueno has earlier said there is nothing wrong with Dela Rosa’s trip as it had the permission of Duterte.<br /><br />
“He asked permission naman from the president. Saka on leave naman siya, hindi naman counted as official duty din 'yung pagpunta sa Las Vegas,” Sueno said.<br /><br />
Pacquiao has also defended Dela Rosa’s trip. <br /><br />
“Alam mo kami mga Bisaya, okay lang 'yan ilibre kaysa gumawa ng kalokohan. Kaming mga Bisaya, ayaw namin ng kalokohan. Mas mabuti pa manlibre ka. Kesa makakalokohan diyan,” he said.<br /><br />
Dela Rosa and Pacquiao returned to Manila early Tuesday morning.<br /><br />

Robredo cracks joke about SC amid Bongbong protest

With a joke, Vice President Leni Robredo alluded to her fate being at the hands of the Supreme Court amid a pending protest by former Senator Ferdinand "Bongbong" Marcos Jr. against her.<br /><br />
Speaking at an economics and governance conference at Ateneo de Manila University on Thursday, Robredo cracked wise while greeting school officials including including university vice president Maria Luz Vilches.<br /><br />
"Before I proceed, let me first greet the school officials who are here," Robredo said. "Of course, our vice president..."<br /><br />
As her audience laughed, the Vice President quipped: "Ito, sigurado hindi matatanggal ng Supreme Court."<br /><br />
The joke, met by loud cheers and applause, came two days after the Supreme Court ruled to allow the late former President Ferdinand Marcos' burial at the Libingan ng mga Bayani.<br /><br />
The decision favoring the elder Marcos has led to murmurs that the tribunal will also rule in favor of the younger Marcos. The SC will decide on the protest as its members constitute the presidential electoral tribunal (PET).<br /><br />
Robredo had earlier admitted to hearing about these, but said she tries to be optimistic about the matter, keeping her attention on her anti-poverty initiatives and work as housing czar.

"We cannot talk seriously about the Philippines' growth prospects without considering as well the depth and scope of our country's history," she said.<br /><br />
"To truly move forward, we must hold a deep reverence for the past, and the truth of its sorrows and victories. We must honor the memory of those who fought for the country, and demand justice from those who betrayed it," she added.<br /><br />

NBI files drug, graft raps vs. De Lima, others over Bilibid drugs

The National Bureau of Investigation (NBI) on Thursday filed several complaints against Senator Leila De Lima and 17 others with the Department of Justice (DOJ) in connection with their alleged involvement in the proliferation of illegal drugs inside the New Bilibid Prison.<br /><br />
Following nearly two months of fact-finding probe, the NBI asked the DOJ to conduct preliminary investigation on De Lima for violation of Sections 5, 26 (b), and 27 of the Comprehensive Dangerous Drugs Act (Republic Act 9165), qualified bribery (Revised Penal Code) and Section 3 (e) of the Anti-Graft and Corrupt Practices Act (RA 3019).<br /><br />
De Lima, a former justice secretary, was also charged for violation of An Act Punishing the Receiving and Giving of Gifts of Public Officials and Employees (Presidential Decree 46) and Section 7 of the Code of Conduct and Ethical Standards for Public Officials and Employees (RA 6713).<br /><br />
Facing complaints for direct bribery and violation of Section 3(e) of RA 3019, PD 46 and Section 7 (d) of RA 6173 are the following:<br /><br />
<div>former Bureau of Corrections chief Franklin Jesus Bucayu</div>
<div>former Justice Undersecretary Francisco Baraan III</div>
<div>former Bucor officer-in-charge Rafael Ragos</div>
<div>De Lima's former security aide and Presidential Security Group Member Joenel Sanchez</div>
<div>De Lima's former driver and bodyguard Ronnie Dayan</div>
<div>Ragos'close-in aide and NBI agent Jovencio Ablen Jr.</div>
<div>Bucayu's alleged bagman Wilfredo Elli</div>
<div>DOJ employee Jesusa Francisco</div>
<div>De Lima's personal assistant during her DOJ stint Lyn Sagum</div>
<div>a certain Julius Rejuso</div>

High-profile inmates were also included in the charge sheet, specifically in relation to the sale and distribution of illegal drugs which is punishable under RA 9165.<br /><br />

The NBI based its complaints on sworn statements, documents, and testimonies of various resource persons, including inmates, who took part in the inquiry of the House of Representatives on the issue.<br /><br />
The complaints will likely be consolidated with two others pending before a five-man panel of prosecutors formed by Justice Secretary Vitaliano Aguirre II.<br /><br />
De Lima has repeatedly denied the allegation that she protected drug syndicates inside the NBP in exchange for funds for her 2016 election campaign.<br /><br />
She accused the government, whom she criticized for its bloody war on drugs, of fabricating evidence and coercing witnesses to testify against her. 
Complaint<br /><br />
In its complaint, the NBI said De Lima failed to fulfill her mandate of ridding the national penitentiary of illegal drugs during her five-year stint at the DOJ.<br /><br />
"Instead of fulfilling this mandate, Senator De Lima effectively brought about, supported and even promoted the proliferation of illegal drugs by conspiring with inmate gang leaders, for the purpose of furthering her political ambitions," the complaint read.<br /><br />
De Lima's claim that she initiated the much publicized raid in the NBP's maximum security compound in December 2014 also deserves "scant consideration," the NBI said.<br /><br />
"Although it is true that a raid was conducted, contraband confiscated and prisoners transferred, we are still faced with the quandary of whether that which occurred was an honest and legitimate operation meant to cleanse the NBP of illegal narcotics, or one that was merely staged for the purpose of giving the public the appearance that Senator De Lima took the necessary steps to thwart the drug trade inside the NBP," it said.<br /><br />
What was clear to the NBI is that De Lima could not have been successful in pooling campaign funds without the "indispensable support and involvement" of Baraan, who had supervision over the BuCor, Bucayu and Ragos.<br /><br />
The agency said Baraan, Bucayu and Ragos were appointed to their positions through De Lima's intervention and "thus practically owed her a huge debt."<br /><br />
"In the final analysis, it is this culture of shameless corruption exacerbated during the terms of Secretary De Lima, Justice Undersecretary Baraan, Director Bucayu and OIC Director Ragos, including all their confederates as named herein, that ultimately led to the opening of floodgates for all kinds of illicit activities inside the NBP, most notably the proliferation of illegal drugs," the NBI said.<br /><br />

Justice Secretary Vitaliano Aguirre II on Sunday linked Sen. Leila De Lima to the killing of Albuera, Leyte Mayor Rolando Espinosa.<br /><br />
In an interview on radio dzBB, Aguirre called De Lima the "common denominator" in the killing of a Cebu policeman who allegedly squealed on narco-generals; the fatal stabbing of alleged drug lord Tony Co inside New Bilibid Prison; and Espinosa's shooting on Saturday.<br /><br />
Aguirre did not name the policeman killed in Cebu, but Police Officer 2 Ryan del Castillo was found dead in Lapu-Lapu City last August after accusing Deputy Director General Marcelo Garbo and retired Chief Superintendent and now Daanbantayan, Cebu Mayor Vicente Loot for illegal drug involvement.<br /><br />
"Ang lahat nang ito ay parang may common denominator... Ang protector at mga involved dito ay yung mga drug lords at protectors nito na pinangungunahan, ayon sa affidavit na ginawa ni Mayor Rolando Espinosa, si Sen. De Lima," Aguirre said.<br /><br />
Aguirre said that De Lima was the first person listed by Espinosa in his affidavit of illegal drug coddlers.<br /><br />
"May affidavit si Mayor Rolando Espinosa; tinuro niya yung mga taong involved sa droga. Ang number one na enumerated niya ay si De Lima. Iisipin mo na although pulis o CIDG gumawa niyan, puwede din naman na talagang gamitin, nagpapagamit yang mga pulis na 'yan para patahimikin yung puwede mag-squeal sa kanila," he said.<br /><br />
Aguirre, who was in Las Vegas to watch Sen. Manny Pacquaio's fight, said that Espinosa's affidavit can no longer be used against any person because of his death.<br /><br />
CIDG Region 8 operatives led by Chief Inspector Leo Laraga killed Espinosa and drug suspect Raul Yap inside their jail cells while serving search warrants at the Baybay, Leyte Sub-Provincial Jail early Saturday.<br /><br />
Laraga claimed that they shot Espinosa and Yap in self-defense.<br /><br />
Aguirre said even NBP high-profile inmates, such as Jaybee Sebastian, who testified at the House probe on the proliferation of illegal drugs, attested to De Lima's influence.<br /><br />
"Bago magkaroon ng hearing diyan sa House committee on justice ay itong mga high profile inmates ay nagsabi na si Sen. De Lima rin ang protector sa laganap na bentahan ng droga diyan sa NBP. Dapat talagang sisirin ng malalim ito para malaman ang tunay na katotohanan," he said.

Meanwhile, Aguirre ordered the National Bureau of Investigation to conduct a parallel investigation into Espinosa's killing.<br /><br />

Aquino noted, at this point, he is "just any other citizen, waiting for their decision." He said he stayed mum on the issue to let the voice of the other victims of Martial Law be heard, and for it to be seen that the issue is not one simply within his family and the Marcoses.<br /><br />
"Dahil sa usaping ito, parang pinipilit ng ilang tao na yung nangyari raw noong Martial Law ay away lang ng pamilya namin ng mga Marcos, so minabuti ko na tahimik muna at marinig natin ang mga boses nung iba pang nabiktima nung Martial Law. [So that it would be seen that this is not merely a fight between our families. This is a fight of many Filipinos who are still searching for justice.]<br /><br />
Aquino is the only son of former Senator Ninoy Aquino and former President Corazon Aquino, two icons who fought for democracy who were instrumental in ousting Marcos.<br /><br />
Ninoy, a staunch critic of the Marcos administration, was incarcerated and eventually assassinated at a tarmac in 1983. Corazon, meanwhile, rose to the presidency after the Marcos ouster.

MANILA, Philippines – Lingayen-Dagupan Archbishop Socrates Villegas on Tuesday evening, November 8, denounced the Supreme Court (SC) decision to allow a hero's burial for the late dictator Ferdinand Marcos.<br /><br />

Villegas is the protegé of the late Manila Archbishop Jaime Cardinal Sin, who helped oust Marcos through the EDSA People Power Revolution of 1986.<br /><br />

"I am very sad. The burial is an insult to the EDSA spirit," Villegas, president of the Catholic Bishops’ Conference of the Philippines (CBCP), said in a text message to Rappler on Tuesday evening.<br /><br />

Villegas also said of the SC ruling: "It mocks our fight to restore democracy. I am puzzled and hurt, and in great grief."<br /><br />

Villegas issued this statement on Tuesday as archbishop of Lingayen-Dagupan in Pangasinan, not as CBCP president. He said the CBCP statement is "still being prepared."<br /><br />

Villegas was the 25-year-old private secretary of Sin when Filipinos ousted Marcos and restored Philippine democracy on February 25, 1986. <br /><br />

The archbishop issued his statement shortly after the SC on Tuesday voted 9-5 to allow a hero's burial for Marcos, as proposed by President Rodrigo Duterte.<br /><br />

The Marcos family celebrated the ruling as a vindication, but the late dictator's critics said it disregards the human rights abuses and other wrongdoing during the Marcos regime.

A majority of Supreme Court (SC) justices are poised to reject the petitions seeking to stop the burial of the late strongman Ferdinand Marcos at the Libingan ng mga Bayani (LNMB), court sources told The Manila Times.<br /><br />

An unimpeachable source said several SC justices have manifested their intention to uphold President Rodrigo Duterte’s order to allow Marcos’ burial at the LNMB, argung it was issued by virtue of his “presidential prerogative.”<br /><br />

The Manila Times was also able to gather the inputs of at least eight justices of the SC who shared their opinions on the issue. A head count of the justices showed that there was a sufficient number for the rendering of a decision junking the petitions.<br /><br />

SC justices are scheduled to vote on the petitions on Tuesday, November 8.<br /><br />

Another source inside the SC even noted that the number of justices poised to junk the petitions seeking to block Marcos’ burial at the LNMB could go up from eight to 10.<br /><br />

Several justices contend that Marcos may be buried at the LNMB because there is no law prohibiting it and the order for his interment there was issued within the bounds of the President’s authority.<br /><br />

Another SC source said Marcos has the right to be buried in “government property” as a former president and as a soldier who was even awarded a medal of valor.<br /><br />

“Libingan ng mga Bayani is the cemetery for soldiers and presidents and there is no law law prohibiting him to be buried there. It is within the powers and prerogative of President Duterte,” the SC source pointed out.<br /><br />

Only seven votes are needed to allow the burial of the late strongman and this can be easily mustered.<br /><br />

There are only 14 justices set to vote on the petitions since Associate Justice Bienvenido Reyes has inhibited himself from the case. Reyes is a classmate of Duterte at the San Beda College of Law and also a close friend and business partner of former President Benigno Aquino 3rd.<br /><br />

The original ponente or writer of the decision was Associate Justice Alfredo Benjamin Caguioa who, in his draft, granted the petition and disallowed the burial of Marcos at the LNMB.<br /><br />

The Caguioa draft decision was opposed by Associate Justice Diosdado Peralta who, in his draft dissenting opinion, denies the petitions to the case and grants the burial.<br /><br />

Peralta opines that there was no grave abuse of discretion on the part of the Chief Executive in ordering the burial of Marcos at the LNMB.<br /><br />

Once the Peralta decision gets the majority votes from the other justices, Caguioa’s draft decision will serve as the leading dissenting opinion in the case.<br /><br />

The SC source said the votes “to watch” are the those of justices who have already shown their “actuations” against Marcos’ burial at the LNMB, namely: Chief Justice Maria Lourdes Aranal-Sereno and Associate Justice Marvic Leonen.<br /><br />

The petitions were filed by former Bayan Muna Representative Satur Ocampo, et al.; Albay Rep. Edcel Lagman, et al.; former Commission on Human Rights (CHR) chairwoman Loretta Ann Rosales, et al., former senator Heherson Alvarez, et al.; and Zaira Baniaga, et al.<br /><br />

The memorandum allowing the interment, dated August 7, was signed by Defense Secretary Delfin Lorenzana and addressed to Armed Forces Chief of Staff Gen. Ricardo Visaya. The memo informed Visaya of the order of President Rodrigo Duterte on July 11 regarding Marcos’ burial at the Libingan for purposes of planning and coordination.<br /><br />

Government lawyers, headed by Solicitor General Jose Calida, defended this by saying that Marcos’ achievements as a soldier who fought against the Japanese during World War II would not be diminished just because he was ousted via the first “people power” revolt in 1986.<br /><br />

The proposed burial was stopped by the SC via a status quo ante order issued pending the resolution on the petitions challenging Duterte’s move to allow the burial of Marcos.<br /><br />

The LNMB, a military-owned cemetery, is where fallen soldiers, national artists, and other personalities “worthy of emulation” are interred.<br /><br />

Petitioners cite atrocities during Marcos’ Martial Law regime as the main argument against the planned burial.

Public attention shifts back to the Supreme Court (SC) on Tuesday as the justices are expected to resolve the issue on whether former President Ferdinand Marcos Sr. deserves a spot in the Libingan ng mga Bayani.<br /><br />
The voting will take place in the high tribunal's weekly session, its first since taking a three-week break which pro- and anti-Marcos hero's burial groups used to make public appeals to the justices to rule in their favor.<br /><br />
Fourteen out of 15 justices will decide on the matter since Associate Justice Bienvenido Reyes, who administered the oath of office to President Rodrigo Duterte on June 30, inhibited due to "close relations" with a party in the case.<br /><br />
At least eight votes are needed to block the burial that is being pushed by Duterte while those in favor only have to muster seven votes.<br /><br />
In case of a deadlock, Section 7, Rule 56 of the Rules of Court provides that the SC en banc shall deliberate on the case again.<br /><br />
If the voting remained the same after re-deliberation, the consolidated petitions against the planned hero's burial for the late strongman are deemed denied.<br /><br />
Remember Martial Law victims<br /><br />
Optimistic about their chances, Barry Gutierrez, counsel for one of the petitioners, hoped that the justices "remember the sacrifice of everyone who died fighting the Marcos dictatorship and decide against the Marcos burial at the Libingan ng mga Bayani."<br /><br />
"It is our wish that the Supreme Court, as final arbiter of constitutionality, remember its history and spirit, and not reward the tyrant with a false and undeserved place in history,"  Gutierrez said in a statement.<br /><br />
Ilocos Norte Governor Imee Marcos, a daughter of the late strongman, also expressed confidence about a favorable outcome.<br /><br />
"Legally, we are very confident. On the other hand, there are so many political aspects to this case and we should be mindful and prayerful," she told reporters on the eve of the SC deliberations.<br /><br />
Marcos was supposed to be interred in the heroes' cemetery on September 18, but the SC halted the defense department's preparations for the burial through a status quo ante order (SQAO) to give way for thorough deliberations, including oral arguments, on the case.<br /><br />
Issued on August 23, the stay order has been extended twice and is due to expire on Tuesday.

Burial won't make Marcos hero<br /><br />
Petitioners had argued that Marcos was no hero, citing his dubious record as a war soldier and massive human rights violations and corruption that tainted his 20-year rule.<br /><br />
They also said that the Libingan burial violates the law giving compensation to Martial Law victims and the 1992 agreement between former President Fidel Ramos and the Marcos family to allow the return of the former president's body to the Philippines but to have it buried in his home province of Ilocos Norte.<br /><br />
The petitioners, some of them claiming to be human rights victims during Martial Law, also said the burial will reopen the wounds of the dictatorial rule, where thousands had been killed, tortured and disappeared for opposing Marcos.<br /><br />
The government, however, said there is no law prohibiting Marcos from being buried at the Libingan ng mga Bayani, a cemetery reserved for soldiers, former presidents, national artists and statesmen, and that it is within Duterte's power and prerogative to allow the burial.<br /><br />
“The interment of the remains of former President Marcos does not and will not make him a hero,” the Office of Solicitor General (OSG) said in its comment submitted to the high court.<br /><br />
“On the contrary, the interment of his remains at the Libingan was due to the fact that the late Ferdinand Marcos was a former President of the Republic, statesman and soldier, whose remains may be and are to be interred at the Libingan.”<br /><br />
A World War II veteran, Marcos was also neither dishonorably discharged nor convicted of a crime involving moral turpitude despite his ouster from office through a People Power revolt in 1986, according to the government.<br /><br />
The government also said the petitioners' claims for compensation as human rights victims are "distinct and separate from, and cannot in any way be connected to, the intended burial" because the process of vetting their claims under Republic Act 10368 is still ongoing.<br /><br />
Lastly, the government said the burial will promote national healing and closure to one of the most contentious chapters of the nation's history, a belief shared by the Marcos family and their supporters who held an overnight vigil in front of the high court ahead of Tuesday's vote.<br /><br />
Marcos died while on exile in Hawaii in 1989.<br /><br />
His remains, brought home in September 1993, lie inside a glass coffin and on public display at the Marcos Museum and Mausoleum in Batac, Ilocos Norte.<br /><br />

Allies of President Rodrigo Duterte at the House of Representatives on Monday stressed he is immune from suit following Sen. Leila de Lima's Supreme Court petition for a writ of habeas data against the chief executive.<br /><br />
"I don't know if the Supreme Court (SC) will try to change a long-standing policy. It's been a long-standing policy that the president has immunity from suits," said Taguig Rep. Pia Cayetano.<br /><br />
The Taguig lawmaker said she does not see "any reason to change that" rule on the president's immunity.<br /><br />
Like Cayetano, Cebu Rep. Gwendolyn Garcia said the decision whether to grant De Lima's plea should be left to the high tribunal.<br /><br />
"This is really a question that the SC should answer because as far as we know, as far as all the past administrations have been concerned, the president is immune from suit," Garcia said.<br /><br />
The Cebu congresswoman also reminded critics of Duterte that the option to file an impeachment complaint against the President is always available to them.<br /><br />
Garcia, however, said De Lima has every right to manifest her grievances through a complaint or a petition.<br /><br />
"Well everybody naman has that right. It's a constitutionally guaranteed right to sue," said Garcia.<br /><br />
"I think it should not be a matter of trying to make this a gender-sensitive issue because whoever would feel that they are being harassed or that they would need to take redress before the court, that is a constitutional right that can anybody can avail of, man or woman," she added.<br /><br />
De Lima said she decided to file the petition because of the attacks that Duterte has launched against her as a person and as a woman.<br /><br />
She said this was "the first of a series of legal offensives" she would file against Duterte. De Lima said the cases would stand as a test against Duterte's presidential immunity.<br /><br />
De Lima said the verbal attacks on her person are not covered by presidential immunity from suit because these are not the official acts of a President.<br /><br />

She also likened the affidavit to what she called the "fabricated" testimony of convicted crime lord Jaybee Sebastian who told a House of Representatives inquiry that he gave the senator millions of pesos in drug money when she was still Justice secretary. <br /><br />
"Iyung affidavit na iyan [ni Espinosa] ay inabot lang sa kanya at iyung mga sinasabi doon, lalo na iyung mga pangalan ay hindi daw galing sa kanya. Katulad lang din iyan ng mga so-called affidavit ng mga nag-testify doon sa House inquiry, katulad nun ni Mr. Jaybee Sebastian na pinilit lang sa kanya," she said. <br /><br />
(The affidavit was only handed to him and its contents, especially the names listed there, were not from him. That is just like the so-called affidavit of Jaybee Sebastian who was also coerced.)<br /><br />
"Pilit na naman akong nili-link, ini-implicate kay Espinosa, wala nang katapusan. Kaya nga ang paborito kong battlecry ngayon, 'Invent pa more.' Fabrication na naman iyan," she added. <br /><br />
(They are again trying to link me, implicate me through Espinosa, it never seems to end. That's why my favorite battlecry now is, 'Invent pa more.' That is a mere fabrication.)<br /><br />
De Lima also criticized government authorities for the death of Espinosa who was already incarcerated at the Baybay Provincial Jail before he was killed allegedly in a shootout with operatives of the PNP Criminal Investigation and Detection Group (CIDG).<br /><br />
She theorized that Espinosa was killed by those who have links to the drug trade.

She also said there was a possibility Espinosa would retract the alleged statement linking her to the drug trade. <br /><br />
The former justice chief said her ongoing word war with Duterte is an "unwinnable battle" since the President is the one making sure that she is placed behind bars. <br /><br />
Duterte had alleged that De Lima's former driver and alleged lover collected money from drug lords detained at the New Bilibid Prison when she was justice secretary.<br /><br />
On Monday, De Lima filed a petition for habeas data against Duterte. The petition for habeas data is a legal remedy to secure information related to a person whose life or liberty is at risk.<br /><br />
She said her camp will lodge more cases against the President and other officials leading the "harassment" against her.

A LIST BEFORE HIS DEATH<br /><br />
In a DZMM interview, Chief Inspector Jovie Espenido, head of the Albuera Municipal Police, said he was able to persuade Espinosa to name officials with alleged links to the illegal drug trade. <br /><br />
He said Espinosa's affidavit included De Lima's name and several others including: <br /><br />
- former CIDG-Region8 Director, Superintendent Joey Masunding; <br /><br />
- retired Ormoc City Jail warden Joseph Nuñez; <br /><br />
- Victor Espina Jr., the brother of retired Philippine National Police (PNP) Deputy Director General Leonardo Espina; and, <br /><br />
- Jonnah John Ungab, the incumbent vice mayor of Ronda town in Cebu. <br /><br />
The Albuera police has filed anti-drug complaints against 80 individuals in Espinosa's affidavit, Espenido said.<br /><br />
Espenido admitted that Espinosa's death dealt a heavy blow to the cases filed.<br /><br />
"We know that here in the Philippines, the case is often dropped if the complainant or the witnesses die. Cases are sometimes dismissed even if they alive, what more if they are already dead," he said. <br /><br />
 
He added that he is uncertain if the testimony of Espinosa's son, suspected drug lord Kerwin Espinosa who was arrested in Abu Dhabi last October, could bolster the case. <br /><br />
"Makasiguro ako na si Mayor talaga ang tumulong sa gobyerno para malaman talaga kung sino iyung mga protector nila kasi nagbigay na siya ng salaysay. Kay Kerwin, hindi ako makasiguro kasi hindi natin alam kung sino ang maghawak," he said. <br /><br />
"Sabi nga rin ng mga kasamahan ko sa serbisyo, pwedeng isangkot tayo para iyung credibility ng leader ng nag-iimbestiga sa kanya, masira. Ang dami talaga ng mga expectation ko, baka naman din patayin." <br /><br />
PNP chief Ronald "Bato" dela Rosa has ordered an investigation into Espinosa's death, promising that there would be no cover-up in the process.<br /><br />
