Duterte dares US to file human rights complaint before UN

President Rodrigo Duterte on Saturday night dared the United States government to file a human rights complaint against him before the United Nations over his war on drugs.<br /><br />
"We are members of the United Nations. Akala ko ba may mga abogado kayo? If you have something, you go to the United Nations assembly. You shout your complaint, and you cry there and then ask for a motion that I, the Philippines be investigated," Duterte said during a speech in General Santos City.<br /><br />
"Then if there's a result, you submit it, you call our attention and then we talk," he added.<br /><br />
Duterte made the suggestion as he complained against the US' "nitpicking" and using the international stage to reprimand him over alleged extrajudicial killings of drug suspects in the Philippines.<br /><br />
He said that even when he was still a mayor, he had been the US' "favorite whipping boy' on human rights. Duterte had been accused during his term in Davao City of sanctioning the killings of criminals allegedly carried out by the vigilante group called the Davao Death Squad.<br /><br />
"Noong mayor ako okay lang. Naging presidente ako, I carry on my shoulder the sovereignty of the people. You do not reprimand me or chastise me in public. I won't accept.. nakakainsulto iyang ginagawa ninyo, and every time you talk about the suspension of aid... iyong assistance, 'We will not give you.' You have done that to the so many presidents of this country," Duterte said.<br /><br />
Curses at US<br /><br />
The President also cursed at the US as he mentioned the US' Millennium Challenge Corporation Board's decision to defer the selection of the Philippines as a recipient of a multi-million dollar development grant over concerns on "rule of law and civil liberties."<br /><br />
He also cited the US State Department's cancellation of a firearms' sale to the Philippines.<br /><br />
"Akala mo every time you criticize, you always connect it with the aid. Bullshit you guys. You know what, I tell you straight, you invaded my country, sat on it for 50 years and you have the gull to say to us that you we do not give you the aid. Son of a bitch. You are a son of a bitch. Do not do that to us," Duterte said.<br /><br />
The president, meanwhile, said that the Philippines will be able to survive without aid from the US.<br /><br />
He said that the US can "swallow" its assistance and just give it to the thousands of homeless Americans.<br /><br />
"I've been to China. China [said] we will you something $50 billion. Tang****** Millennium mo, iyo na 'yan. Tulong mo sa mga Amerikano na natutulog sa labas," he said.<br /><br />
Duterte apologized for "having this bad mouth" but insisted that he had been cursing against the US for trivializing the country's drug problem.<br /><br />
He reiterated that "nothing can stop him" from solving the country's drug problem.<br /><br />
He said that his only goal is "the preservation of my country."<br /><br />
"It is to protect the next generation so that there will be Filipinos with sound mind and sound body to run this country when we are no longer here on this planet," Duterte said.

Confessed former hitman Edgar Matobato is willing to be executed if the government reimposes the death penalty on the condition that President Rodrigo Duterte would be the first in line on death row.<br /><br />
"Sana siya ang mauna kasi siya ang founder. Susunod kaming mga tao niya," Matobato said in Raffy Tima's exclusive report on GMA News TV's "State of the Nation."<br /><br />
"Willing akong magpabitay, sir... basta kasama ko yung mga kasamahan ko, kasama yung si Presidente. Siya ang puno ng patayan na yan," he added.<br /><br />
Malacañang has yet to give a reaction to Matobato's remarks.<br /><br />
Duterte is in the middle of a trip to Cambodia and Singapore.<br /><br />
Matobato in a Senate inquiry confessed that he killed suspected criminals years back as part of a vigilante group. He said it was Duterte who formed the hit squad.<br /><br />
He has since been dispensed as a witness by the Senate Committee on Justice and Human Rights after it noticed inconsistencies in his testimony.<br /><br />
Matobato earlier last week filed murder and crimes against humanity against Duterte and several others in connection with the killings allegedly perpetrated by the Davao Death Squad.

Reinstating death penalty instead of fixing the criminal justice system is a “lazy” solution to curb criminality in the country, a Catholic Church leader said.<br /><br />
"Cleanse the police ranks! Fix all the courts! Tighten (the security) at the [New] Bilibid [Prison] and other prisons. <br /><br />Death penalty is a lazy form of penalty instead of helping reform those who made mistakes," Archbishop Socrates Villegas of Lingayen, Dagupan was quoted as saying in a CBCP News report.<br /><br />
Villegas, president of the Catholic Bishops Conference of the Philippines, said overhauling the justice system is more workable than reimposing the death penalty.<br /><br />
He added that death penalty, in a weak justice system, will make the poor suffer ever more, while the rich and powerful will most likely get away with crimes.<br /><br />
"If there's death penalty but the criminal justice system is corrupt, slow and one-sided, rapist and plunderer, and pusher and killer will remain confident (to commit crime). It's business as usual," he said.<br /><br />
But opposing death penalty, Villegas said, does not make the Church soft on crimes.<br /><br />
"The solution is not killing criminals. Our alternative is fullness of life for the guilty and the innocent. Fullness of life for the poor and the rich. Fullness of life for sinners and saints," Villegas added.<br /><br />
The House justice committee on Wednesday approved its report on a substitute bill seeking to reimpose the death penalty as punishment for heinous crimes.<br /><br />
Among the panel members, 12 voted to approve the report, six voted against it, and one abstained.<br /><br />
Following this, the Archdiocese of Manila issued a prayer to urge its clergy and the faithful to pray against the revival of death penalty.<br /><br />
Fr. Reginald Malicdem, rector of the Manila Cathedral, asked all clergymen and women superiors of religious communities, and heads of schools in the archdiocese to say the "Prayer Against Death Penalty" starting December 11 and through the Christmas Season.

And I do not need the confirmation, ‘yung mga—Alam mo ‘yang yellow, pati ‘yang demonstration. ‘Yang yellow lang ang gusto akong tanggalin kasi hindi maka—They cannot accept defeat," he said.<br /><br />

He did not specify which group wants him kicked out of office, but the previous administration's ruling party, Liberal Party, uses yellow as its campaign color.<br /><br />
"Pero ‘yung mga Left, kailanman papatayin ka pa niyan 'pag tanggalin mo ako. Kasi left ako. Anak lang ako ng mahirap. I’m the first Left-leaning president. But I am not under or I am not a member of the Communist Party of the Philippines [CPP]," he added.<br /><br />
On Monday night, Duterte also claimed that the communists will die for him.<br /><br />
The statement was made as the government and the National Democratic Front peace panels are at a deadlock because of the release of the political prisoners.<br /><br />
Duterte said that he would only release prisoners when a joint ceasefire agreement has been signed by the government and NDF peace panels.<br /><br />
Meanwhile, the Liberal Party had denied that it is plotting an ouster against Duterte.

Senator Richard Gordon on Wednesday downplayed the award received by Senator Leila de Lima for being one of the “leading global thinkers” for 2016, saying she was just “fishing” to “gain credibility.”<br /><br />
In an interview with reporters, Gordon even said that the government of the United States, where De Lima received her award, may be behind it.<br /><br />
“Baka naman nakikialam na Amerikano dito dahil galit sila sa nangyayari. Alam mo we should not allow other countries to intervene,” he said.<br /><br />
“They can comment, pero katulad n'yan nag-iimbestiga, bibigyan mo ng award, talagang nagfi-fish ka ng award to gain credibility,” Gordon added.<br /><br />
He said he was familiar with such ploy.<br /><br />
“Alam ko naman yung laro na 'yan. Kung ako abogado ni De Lima, ganun din gagawin ko eh. Bibigyan ko siya ng recognition abroad,” Gordon said.<br /><br />
“Eh sino ba yun? Ngayon ko lang narinig yun eh,” he said.<br /><br />
Senators Gordon and De Lima have been at odds over the investigation on incidents of extrajudicial killings committed amid the Duterte administration’s war on drugs.<br /><br />
De Lima, former chairperson of the Commission on Human Rights and former justice secretary, is honored “for standing up to an extremist leader” as one of the 13 global thinkers in the “Challengers” category under the 100 leading global thinkers for this year.<br /><br />
“Since taking office in June, Philippine President Rodrigo Duterte has waged a brutal war on drugs. Thousands of alleged traffickers, dealers, and users have been executed by state forces or pro-government vigilantes,” the citation said.<br /><br />
Among the FP’s 100 Leading Global Thinkers for 2016 are individuals and organizations that have championed worthy causes.<br /><br />
They include former US State Department Hillary Clinton, German Chancellor Angela Merkel, Canada Prime Minister Justin Trudeau, and United Nations Secretary General Ban Ki-Moon.

Sen. Richard Gordon on Wednesday said President Rodrigo Duterte is opening himself to a possible impeachment proceeding following his statement that he had personally killed criminals.<br /><br />
“When he says that, he’s opening himself up, 'di ba? Siya ang nagsabi eh. So ano ang legal way, eh 'di mag-impeach kayo,” Gordon said.<br /><br />
“I’m sure he knows how to defend that,” the senator added.<br /><br />
Gordon pointed out that Duterte, as chief executive, may only be removed from his post through an impeachment proceeding.<br /><br />
He said he was no longer surprised with Duterte’s statement, reiterating his earlier remark that “loose lips, sink ships.”
“Kung magsalita 'yan, magagamit sa kanya 'yan. He’s a lawyer. Alam niya 'yan. Matagal pa siyang piskal. Alam niya ginagawa niya,” Gordon said.<br /><br />
In a speech in Malacañang earlier this week, Duterte said he led the Davao police by example and joined their operations to “personally” kill criminals. Duterte was mayor of the city for more than two decades.<br /><br />
"We do not, you know, we do not wrap people with plastic tape. We are not producing mummies in the Philippines for export. Those are indications of torture," he said.<br /><br />
"Why will I torture when we are going to arrest you because you are committing a crime? There’s no need for us to torture or rather you just shoot him and fire a bullet in the head. Why go into this charade of wrapping people? You don’t indicate that there are tortures and forcing people to say something," Duterte said.<br /><br />
He said only a third of the reported drug-related killings were a result of police operations.<br /><br />
"But in Davao I used to do it personally. Just to show to the guys that, if I can do it why can’t you? And I go around in Davao with a motorcycle, with a big bike around and I would just patrol the streets and looking for trouble also. Talagang naghanap ako ng engkwentro para makapatay," he said. <br /><br />
Senator Gordon earlier said there was no proof that the killings were state-sponsored. He said this in the committee report filed in his capacity as Senate justice panel chairman.

Samantala, sinabi naman ni Presidential spokesman Ernesto Abella na bahagi ng edad o "part of wear and tear" ang mga nararamdaman mga sakit sa katawan ng 71-anyos na pangulo.<br /><br />

Hiniling sa Malacañang nina Bayan Muna Rep. Carlo Isagani Zarate at Anakpawis Rep. Ariel Casilao, ng Makabayan bloc, na isapubliko ang tunay na kalagayan ng kalusugan ni Duterte.<br /><br />
"Mas makabubuti kung maglalabas ng medical bulletin ang Pangulo. Hindi naman niya mamasamain ito," ani Zarate.<br /><br />
"Let us be assured kung anuman ang magiging status ng kalusugan ay malalaman directly from the president," dagdag naman ni Casilao."Let us be guaranteed that he is able (and that) he is very fit to continue with his work."

On her Twitter page, De Lima said: “I’m sorry there’s no award for kowtowing to the President.”<br /><br />

To "kowtow" is to be excessively subservient to one's boss.<br /><br />

De Lima, former chairperson of the Commission on Human Rights and former Justice secretary, was honored “for standing up to an extremist leader” as one of the 13 global thinkers in the “Challengers” category under the 100 leading global thinkers for this year.<br /><br />
“Since taking office in June, Philippine President Rodrigo Duterte has waged a brutal war on drugs. Thousands of alleged traffickers, dealers, and users have been executed by state forces or pro-government vigilantes,” the citation said.<br /><br />
Among the Foreign Policy’s 100 Leading Global Thinkers for 2016 are individuals and organizations that have championed worthy causes.<br /><br />
They include former US State Department Hillary Clinton, German Chancellor Angela Merkel, Canada Prime Minister Justin Trudeau, and United Nations Secretary General Ban Ki-Moon.<br /><br />
Gordon and De Lima have been at odds over the investigation on incidents of extrajudicial killings committed amid the Duterte administration’s war on drugs.<br /><br />
In a committee report, Gordon said there was no proof that the killings were state-sponsored.<br /><br />
In her dissenting report, De Lima called Gordon a "railroading" chairperson who used the Senate justice committee to "attack" senators vocal against Duterte.

DAGUPAN CITY - Catholic priests, students and devotees gathered on Monday night during a “Prayer Rally for Life” organized by the Archdiocese of Lingayen-Dagupan to protest moves in Congress to restore the death penalty. <br /><br />
Church bells rang for 15 minutes as around 3,500 people lit candles and prayed for the enlightenment of lawmakers to prevent the reinstatement of the death penalty, which was recently approved by the House committee on justice.<br /><br />
The archdiocese also launched a signature campaign to be circulated in all churches and submitted to the lower house.<br /><br />
The rally started with a Mass celebrated by Lingayen-Dagupan Archbishop Socrates Villegas.<br /><br />
In his homily, Villegas said the Catholic Church is one with the government’s fight against illegal drugs, corruption, terrorism and all forms of crime but insisted that these matters should not be dealt with through the death penalty.<br /><br />
“Sabi ni Pope Francis, ‘Thou shall not kill’ pertains to the innocent and to the guilty. Hindi ako ang may sabi nun…Ibig sabihin, huwag kang papatay may kasalanan o walang kasalanan,” Villegas said.<br /><br />

A prayer rally was previously held in the province to stand up against supposed drug-related extrajudicial killings, and the burial for former President Ferdinand Marcos at the Libingan ng mga Bayani.<br /><br />
Villegas expressed hope that Congress will hear their plea.<br /><br />
“Nadelay ang voting nila, ‘di ba? Iyon ay isa sa mga tanda na nakikinig sila. Gusto nilang iboto bago mag-Pasko pero dinelay nila kasi nagsalita ang taumbayan. Ibig sabihin, with all due respect sa ating congressmen, nagpapasalamat tayo kasi nakikinig sila,” Villegas said.<br /><br />
(The voting was delayed, wasn’t it? It is one of the signs that they are listening. They wanted to vote before Christmas, but they delayed it because the people spoke up. This means, with all due respect to our congressmen, we are thankful they are listening.)<br /><br />
Other priests in the archdiocese supported the bishop’s statement.<br /><br />

President Rodrigo Duterte on Tuesday said he wants drug addicts to receive medications at home using the P1 billion from the P5 billion check he received from the Philippine Amusement and Gaming Corporation (Pagcor).<br /><br />
"You just stay in your house and I will order medical workers all around the country to go to areas, sa mga may tinamaan ng droga... sa bahay lang ang treatment. Ang mahal diyan kasi ang medisina," Duterte said during his speech at the Ninoy Aquino International Airport before leaving for Cambodia.<br /><br />
Duterte said the Department of Social Welfare and Development (DSWD) will find out where drug addicts live, check their medicines, and supply their medication for treatment. <br /><br />
"There are about four millions of you. I dont know if there will be enough. I still have three [billion]. You can still buy medicines, for example tranquilizer, medicines that will keep you calm, medicines that will restore your sanity kung mahabol pa," Duterte said.<br /><br />
"Mahal, but I hope one billion will go a long way to treat you this Christmas," he added.<br /><br />
In jest, Duterte said he would provide ropes to hopeless drug addicts so that they could just hang themselves.<br /><br />
"Ngayon, 'pag talagang luko-luko na at walang...alibyo na ang katawan, hindi na maisuli, padala ako ng mga lubid. Magbigti na lang kayo," he said.<br /><br />
Duterte, whose violent war on drugs has been criticized both locally and abroad to its increasing death toll, previously mentioned that the P1 billion from Pagcor's P5 billion check will provide free medicines to Filipinos.

Albay Rep. Edcel Lagman on Tuesday belied claims by a leader of the House of Representatives that there is enough support to pass the measure reimposing the death penalty.<br /><br />
"On percentage, I don't know where he got that percentages but we have reports from those who attended the caucus that those who were opposed and those undecided were more than those who said they were for the reimposition," said Lagman in a press briefing of the "Magnificent 7" minority bloc.<br /><br />
Lagman was referring to Majority Leader Rodolfo Farinñas' claim last week that 50 percent of the "supermajority" supported the measure, while only 15 percent opposed it and 35 percent were undecided.<br /><br />
House Speaker Pantaleon Alvarez, however, insisted that the supermajority would prevail, even as he expected the majority bloc to vote as a party on the death penalty reimposition bill.<br /><br />
"Dito sa Kongreso, tingin ko naman we can muster the majority," he said.<br /><br />
Alvarez appealed to the public to just wait for the plenary to vote on the matter, saying: "Ako nang bahala."<br /><br />
On Wednesday last week, Fariñas told reporters that half of the supermajority - made up of 267 of the 293 House legislators - has signified their support for the bill during a caucus on Wednesday.<br /><br />
Around 15 percent of the members is against the measure, while a bigger 35 percent remains undecided, the lawmaker claimed.<br /><br />
Despite this, Farinñas said the majority still decided to defer plenary voting on the measure, and instead undergo extensive plenary debates after the Christmas break.<br /><br />
Fariñas clarified that the deferment of the voting was not brought about by any "pressure" or opposition from the Church or other critics of the death penalty. Fariñas<br /><br />
On Monday, Akbayan Rep. Tom Villarin remained confident that the number of congressmen and congresswomen opposing the reimposition of the death penalty would grow by next year.<br /><br />
"Definitely, many congressmen are pushing for a conscience vote. The main consensus is dapat this is a conscience vote," said Villarin during the press briefing, adding that many lawmakers have yet to reveal their position on the issue.<br /><br />
"We are gaining ground. Even after Christmas, puwede mag-gather ang anti-death penalty supporters," he added.<br /><br />
Lagman also welcomed the position of former President and incumbent Pampang Rep. Gloria Macapagal-Arroyo to continue opposing the reimposition of capital punishment despite belonging to the supermajority.<br /><br />
It was under Arroyo's term as president when the death penalty was abolished in 2006.<br /><br />
"We welcome the position of the former president that she is steadfast in the crusade against the death penalty... We are banking on [the fact] that all those under her party will also vote against the death penalty reimposition," said Lagman.<br /><br />
Arroyo belongs to the Lakas–CMD (Lakas-Christian Muslim Democrats) party.

WASHINGTON - Senator Leila de Lima received an award from a popular international political magazine for standing up to popular leader President Rodrigo Duterte.<br /><br />
The lady senator was among the 100 Foreign Policy Global Thinkers recognized in Washington D.C. on Monday.<br /><br />
Organizers said its honorees prove there are individuals who could step in to ease the suffering of others, especially in today's world where challenging strains of populism seem to be redefining the new normal: from Europe's Brexit and US President-elect Donald Trump's triumph to Duterte's deadly war on drugs that has left thousands of Filipino dead.<br /><br />
De Lima was included in the category "Challengers" and was honored as a global thinker for "standing up to an extremist leader."<br /><br />
"I'd like to think it's because of my stance against the extra judicial killings and other policies ng ating kasalukuyang administrasyon (of our current administration)," De Lima said.<br /><br />
The lady senator warned that the state of human rights and extrajudicial killings in the Philippines will not get better anytime soon.<br /><br />
"Napaka-deplorable po ng sitwasyon natin sa Pilipinas, hinggil sa usapin ng karapatang pantao," she said. "Walang katapusan, araw-araw na pinapatay in the name of the war on drugs... Talaga pong tinutukan natin from day 1."
(The human rights situation in the Philippines is deplorable... There had been countless killings in the name of the war on drugs and we have been monitoring these since day 1.)<br /><br />
"Bihirang-bihira naman tayo nakakita ng mga pinapatay nila na mga high profile drug lords so napaka-questionable talaga," she added.<br /><br />

De Lima said these so-called extrajudicial killings in the Philippines will not stop if no one will stand against it.<br /><br />
"Meron tayong pangulo na talaga namang openly na pino-promote na openly ine-encourage ‘yung killings, di ho ba sa kampanya pa lang niya, ganun na, akala nung iba biro lang ‘yun," De Lima said.<br /><br />
(We have a president who openly promotes and encourages killings. He had mentioned this during the campaign and people thought this was merely a joke.)<br /><br />
For De Lima, her recognition has a higher purpose and meaning, especially in a democracy where critics should be able to dissent without fear of retaliation or retribution.<br /><br />
"Eto po ay para sa Pilipinas, eto po ay para sa… I'm offering this award sa ating mga kababayan lalo na 'yung mga lumaban noon para sa ating demokrasya, 'yung mga lumalaban pa rin ngayon para i-preserve ‘yung gains of democracy," De Lima said.<br /><br />
(This award is for the Philippines. I dedicate this award for our countrymen who fought for our democracy, and for those currently fighting to preserve the gains of democracy.)<br /><br />
Another honoree on the Challengers category is transgender lawmaker Geraldine Roman for "redefining fitness to govern."
Roman was not able to make it to the awarding ceremonies.<br /><br />
Other awardees include outgoing U.N. Secretary-general Ban Ki-Moon "for outrunning Donald Trump to save the planet," Canadian Prime Minister Justin Trudeau "for designing a humane refugee policy," and former Democratic presidential candidate Hillary Clinton "for going high when others go low" during the 2016 US election cycle.

President Rodrigo Duterte has led the Philippines into "a nightmare of brutal slaughter" with his ongoing anti-drug campaign that has so far claimed the lives of more than 5,000 drug suspects, the editorial of the New York Times has declared.<br /><br />
"In the name of eliminating drug crime, President Rodrigo Duterte has plunged the Philippines into a nightmare of brutal slaughter," NYT said in an editorial piece published on Saturday.<br /><br />
The editorial cited more than 2,000 drug suspects and more than 3,500 homicides remain unsolved since July 1, a day after Duterte assumed office.<br /><br />
The NYT said such killings would not have taken place without Duterte's approval since he promised to go after drug personalities during the presidential campaign.<br /><br />
"Even if Mr. Duterte has not directly ordered individual killings, there is no doubt they are being carried out with his approval. Mr. Duterte campaigned on a promise to begin a killing spree to eliminate the country’s drug problem, and he pledged bounties to those who would help," the editorial said.<br /><br />
Duterte has repeatedly denied that the government was behind the deaths under investigation—those committed by unidentified assailants—of drug suspects in the country.<br /><br />
The President, however, has also repeatedly stood by police officers who allegedly shot it out with drug personalities who supposedly chose to fight the law enforcers than be arrested.<br /><br />
The NYT said Duterte continued his war on illegal drugs despite opposition from the United Nations, the European Union, and its long-time ally the United States on his drug war and its alleged human rights violations.<br /><br />
It also cited Duterte's remarks against President Barack Obama, who he called a "son of a whore," and his threats to pull the Philippines out of the UN and the International Criminal Court.<br /><br />
"He has defied calls from the United Nations, the United States and the European Union to stop, instead lashing out, calling President Obama a 'son of a whore' and threatening to pull the Philippines out of the United Nations and the International Criminal Court," the editorial said.<br /><br />
The NYT said it was concerned with how the Duterte's conversation with US President-elect Donald Trump, as narrated by the Filipino leader.<br /><br />
Based on the transcript release by the Presidential Communications Office, Duterte quoted Trump saying the Philippines was "doing it as a sovereign nation, the right way."<br /><br />
"He was quite sensitive also to our worry about drugs... Well we are doing it as a sovereign nation, the right way. And he wishes us well. And I said that, well, we assured him of our ties with America," Duterte said of his conversation with Trump.<br /><br />
The NYT said Trump has yet to challenge the accuracy of Duterte's claims, "leaving the impression that the incoming US president condones the methods of Duterte."<br /><br />
"So far, Mr. Trump, who has business interests in the Philippines, hasn’t challenged Mr. Duterte’s version of the conversation, leaving the impression that the future president of the United States condones the murderous methods of a strongman," it said.<br /><br />
Moreover, the editorial said the threats of Duterte to sever ties with its American treaty ally because of criticisms in his anti-drug campaign sends a signal on the rise of "defiant strongmen."<br /><br />
"Mr. Duterte has also threatened to sever longstanding ties with the United States because of criticism aimed at his anti-drug campaign, and has moved to build stronger ties with China," the NYT said.<br /><br />
"But neither the historic relationship nor America’s vital interests in the region is sufficient reason to be silent about a leader who proudly brandishes his contempt for the rule of law. Doing so sends a dangerous signal to a world where defiant strongmen are on the rise," it added.<br /><br />
The NYT over the weekend published a report on Duterte's anti-drug war.<br /><br />
The story featured photojournalist Daniel Berehulak's report on the cases of 57 homicide victims in 35 days.<br /><br />
The editorial described the report as "the horror being inflicted on a population living in fear that death can strike anyone, at any moment, with impunity."

The Juvenile Justice Welfare Act—the law that exempts 15-year-olds and younger minors from criminal liability—has paved the way for a new generation of criminals, President Rodrigo Duterte said on Monday.<br /><br />
Republic Act 9344, authored by Sen. Francis Pangilinan and enacted in 2006, prohibits the imprisonment of such minors and Duterte said it took away mechanisms for the youth to reflect on their misdeeds.<br /><br />
"I have the highest of respect for Pangilinan. But iyong law, liability, labas-pasok ang mga bata? You can ask any policeman or anyone connected to the law enforcement. It produced a generation of criminals," Duterte said in a speech during the ceremonies of The Outstanding Filipino Awards in Malacañang.<br /><br />
"Pag sabi na below 15, sasabihin na 15... the police must release him immediately or face charges, whatever the crime that child committed. Maybe he would rob and kill. Maybe he would rob and kill and rape. Maski ano, kapag sinabi na 15, release," he added.<br /><br />
Duterte said that the law had great intentions but lacked ways for minors to be held accountable.<br /><br />
This, he said, made the minors in conflict with the law return to committing crimes.<br /><br />
"It was good. But the law did not provide itong mga correctional where they are taught to understand the responsibility. Wala silang sense of accountability," Duterte said.<br /><br />
Sought for comment, Pangilinan said he would want to show Duterte the positive effects of the juvenile justice law.<br /><br />
"I hope the President can give me the chance to explain the positive aspects of the law," said Pangilinan, the chairman of the Senate Committee on Justice in 2006.<br /><br />
"Many of those minors who otherwise would have been thrown in jail, abused repeatedly or even raped while in incsreration have in fact been reformed and are now productive citizens of this country," the senator added.<br /><br />
Defends curfew<br /><br />
Duterte also made a case on implementing a curfew for minors following a report on a riot that killed two persons in Manila.<br /><br />
"I don't know what happened to the petition. Kagabi lang, dalawa patay nag-rambol," Duterte said.<br /><br />
"The Supreme Court has yet to rule on the issue of human rights of children being... You know, we are not arresting the children. We are taking them into custody for their protection. That is why, that is the rationale behind itong curfew," he added.<br /><br />
Duterte was referring to the recent decision of the SC to issue a temporary restraining order the implementation of curfews in Quezon City, Navotas City, and Manila.<br /><br />
"They have to be protected because if they mix up the middle of the night up to the wee hours of the morning and they are into drugs and they are the runners, pagdating ng--pinakialam kasi talaga," Duterte said.<br /><br />
Duterte, when he was mayor, imposed a 10 p.m. curfew in Davao City on unescorted minors.
