Duterte to critics: Adopt an addict

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
President Rodrigo Duterte on Monday again had some choice words for critics of his war on drugs, and even made them a suggestion: adopt an addict.

In a speech delivered at the oathtaking of the People's National Movement for Federalism (PENAMFED) at the Reception Hall in Malacañang, Duterte explained anew that when he assumed the presidency, the budget for the year had already been set by the previous administration. This means that he is limited to that budget, and thus cannot yet build drug rehabilitation centers for addicts.

"Sabi, 'Bakit patayin ni Duterte? Hindi niya lang i-rehab?' Ay na, hindi mo lang alam, mare, na wala na akong mapasukan. Gusto mo, itulong na lang ninyo. Ang mga bahay ninyo, magreserba ka, mga mansyon, mga apat, lima, anim ang mga kwarto. Eh di ibigay ninyo ang isa. Adopt an addict and see what happens. So that's my advice," he said.

"If you want, kayong mga bleeding hearts, if you really want to stop the violence ganoon, mag-adopt na lang. Adopt ng addict. Share a love between your fellow men. Sige... Para malaman ninyo ang perdition ng isang drug addict," he added.

"Kasi kung gusto ninyo, unahin ko iyong sa Tondo. Kayo na ang mamili kung sino ang gusto ninyo doon. Babae, lalaki. Just the same, kapag naloko iyan, sasaksakin kayo diyan. Massacre ang labas. Akala nila ganoon kadali," Duterte also said.

He also urged his critics to go to drug-infested neighborhoods and meet drug addicts so they would know the depth of the problem of the narcotics trade.

"Kayong mga critics, you're better off going into the neighborhoods and find out kung sino ang mga nandiyan. Kanyang mga pari, spend time with people, go out, who are really affected. They're better off giving the advice of how to seek treatment," he said.

Various sectors have criticized the growing death toll in the war on drugs, including religious groups and human rights organizations.

Duterte denies police and military behind EJKs

Unknown 0 4:49:00 PM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
President Rodrigo R. Duterte on Sunday denied that the police and military are behind the extrajudicial killings of thousands of people since he took office in July.

"I do not allow extrajudicial [killings]... We do not do that. It's a dirty job at tsaka para kang hindi lalake," he said during the Belenismo Awards 2016 in Tarlac City.

Police say that 2,004 people have been shot and killed by officers in self-defense during anti-drug operations since Duterte took office on July 1.

Since the government's war on drugs started, alleged drug users and peddlers have been found wrapped in masking tape with placards warning others not to deal with drugs.

Foreign groups such as the European Parliament, the United States, and the United Nations, among others, have already expressed concern over the rising number of deaths in the country.

"'Yang batikos nila sa akin, tama 'yan. Ang police, ang order ko kasi sa police ganito, pati sa military — Hanapin mo sila, arestuhin mo kung pa. Pagka lumaban at may o ano man... that would place the life of the police or military man [in danger], pati siya madadamay, unahan na ninyo," Duterte said.

To recall, the President in June also offered a P3-million reward to those who can capture or kill high-profile drug lords. He also put a bounty on the arrest of the men of the so-called drug lords.

"I'm sorry for those that tinamaan. Simple lang 'to. Huminto lang kayong lahat sa droga, tapos na," he said Sunday.

Ex-Pres. Aquino not yet needed in Senate's dengue vaccine probe – Gordon

Unknown 0 4:41:00 PM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
There was presently no need for former President Benigno Aquino III to testify in the Senate Blue Ribbon Committee's investigation into the P3.5-billion procurement of the dengue vaccine Dengvaxia, committee chair Sen. Richard Gordon said in a statement issued on Sunday.

"At this point in the investigation, we have not invited President Aquino," explained Gordon. "We are not trying to judge anybody here. We are just saying, pumapasok ang gamot na bago, dapat tama ba na ganoon ang patakaran natin. Dapat ba baguhin natin?"

"Remember, we are here in aid of legislation. We cannot prosecute anybody here, we can only recommend but we are not even on that aspect yet."

Those to be invited for the committee's next hearing on the Dengvaxia vaccine are medical experts and officials from the Department of Health (DOH) and its attached agencies, the Department of Budget and Management, and the Commission on Audit. These witnesses are expected to speak on the vaccine's attributes, the testing methods used on it and the results of those tests, and the DOH's procurement process.

Gordon said the Senate inquiry stemmed from concerns over the Dengvaxia vaccine's capabilities, and the manner and sufficiency in the testing of the drug.

"It behooves us in the government to see to it that when we get this kind of medication, we get the best and we must see to it that we examine the test protocol and results and that we come out with all the due diligence required of a good father to a child," the senator said.

The Senate panel conducted its first hearing on the issue on December 6, 2016, following the deaths of two children, who received the first dose of the vaccine in April.

The purchase of some P3.5 billion worth of dengue vaccines by the DOH was made during the Aquino administration.

No appropriation from Congress

Gordon also pointed out that funds for the vaccines' purchase were immediately made available toward the end of year, despite the absence of any appropriation.

"That was a huge amount of money, which was taken from the savings, no appropriation from Congress... It's just like DAP [Disbursement Acceleration Program]... We really need to investigate this," Gordon said.

He also wanted to find out why the dengue vaccine was given priority when only 250 people per year died from the disease with over 200,000 persons afflicted, accounting only for 0.01% of the population.

Additionally, dengue is not among the Top 10 health afflictions suffered by Filipinos.

Gordon also pointed out that testing for the new vaccine had not been completed when the government procured it.

He also questioned why the DOH started a new immunization program for dengue when the country had not yet satisfied the immunization requirements for other deadlier diseases as listed in the Millennium Development Goal.

Despite all these questions, however, Gordon clarified that Congress was not standing in the way of the government's anti-dengue vaccination program.

The vaccine was approved by the WHO in April 2016, the same month that the National Dengue Program was rolled out.

Responding to accusations that Filipino children were used as guinea pigs, the vaccine's manufacturer Sanofi Pasteur argued that though the Philippines was the first to use the vaccine, 11 other countries had approved it.

Where’s change?: Lacson hits Duterte admin’s ‘double standard’

Unknown 0 4:31:00 PM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
It seems that change is not coming, at least for Sen. Panfilo “Ping” Lacson.

Lacson on Friday criticized the Duterte administration for its “double standard” in its brutal war against illegal drugs.

“I thought it was an all-out drug war I was supporting. Talk about double-standard. Talk about double-speak. Change isn’t coming after all,” he said in a Twitter post.

The senator was apparently dismayed over the admission of President Rodrigo Duterte that he was the one who ordered Philippine National Police (PNP) Chief Gen. Ronald “Bato” dela Rosa to reinstate Supt. Marvin Marcos.

Marcos is the police official allegedly involved in the killing of suspected drug lord and former Albuera town mayor Rolando Espinosa Sr.

On Friday night, Duterte admitted that he ordered his closest aide Christopher “Bong” Go to call dela Rosa not to remove Marcos from his post.

The President said it was he who talked to dela Rosa and not Go as earlier accused by Sen. Leila de Lima.

The chief executive said he ordered not to remove Marcos because he was conducting an investigation during that time.

It later turned out that Marcos indeed has links to illegal drugs, Duterte said.

“Si (Asher) Dolina, malinis. Si Marcos, may tama (Dolina is clean, but Marcos has a record),” he said in a speech in Davao City on Friday.

Dolina, who was police director for Eastern Visayas in 2015, was tagged by alleged drug lord Kerwin Espinosa who had allegedly received drug protection money from the drug trafficker.

Cardinal Tagle to public: Give sinners aid, not death

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
MANILA - As President Rodrigo Duterte's allies in Congress push for the reinstatement of capital punishment, Manila Archbishop Luis Antonio Cardinal Tagle on Sunday urged the public to help those who have sinned, instead of "eliminating" them.

Speaking at an Advent recollection in Cubao, Quezon City, Tagle cited the kindness of Jesus Christ that led Zacchadeus, a corrupt tax collector, to give half his wealth to the poor and repay anyone he had cheated fourfold.

Like Jesus, Tagle said the public must "not eliminate those who seem to be impure but give them hope and offer of new life."

The Roman Catholic Archdiocese of Manila earlier released a prayer which aims to combat the reimposition of death penalty in the country.

"Help us to work tirelessly against state-sanctioned death and to renew society in truth, justice, love and respect so that violence will cease and peace may prevail," reads the "Prayer Against the Death Penalty."

Priests were encouraged to include the prayer in the Mass either after the post-communion prayer or as part of the Prayer of the Faithful during the entire Christmas season.

The Catholic Church has remained firm against the imposition of death penalty, arguing that it goes against the Christian faith.

Last Wednesday, voting 12-6-1, the House justice committee approved the committee report of a substitute bill restoring the death penalty.

It proposes three modes of execution: hanging, firing squad, or lethal injection.

The revival of death penalty in the country was a campaign promise of President Duterte.

Kiko Pangilinan clarifies: I didn’t fully agree with Senate panel report on EJKs

Unknown 0 3:07:00 AM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
Sen. Francisco "Kiko" Pangilinan has clarified he was not completely agreeing with the Senate committee report saying there was no proof of government-sanctioned killings in connection with President Rodrigo Duterte's war against illegal drugs.

In a Facebook post, Pangilinan said it was "misleading" to say his signing the report, along with 10 other senators, meant he agreed with the full report, even as he stressed he dissented on some parts of the report.

"It appears that the 11 Senators who signed the committee report agree with its findings when in fact the affixed signature is followed by the words 'I dissent..' which is what I did," said Pangilinan.

"We also stated that we would be filing a separate opinion and in it we will be stating the basis of our dissent on key points," the lawmaker added.

The report was drafted by Senators Richard Gordon and Panfilo Lacson, chairmen of the Senate committees on justice and human rights, and public order and dangerous drugs, which jointly held a probe on extrajudicial killings and summary executions.

Apart from Pangilinan, the remaining eight senators who signed the report were Senators Gregorio Honasan II, Loren Legarda, Juan Miguel Zubiri, Nancy Binay, Manny Pacquiao, Alan Peter Cayetano, Franklin Drilon, and Vicente Sotto III.

Pangilinan noted he “will dissent/concur in part,” Cayetano said he has “reservations and amendments,” while Drilon said he signed “with reservation and will interpellate.”

Those who did not sign the report are Senator Leila de Lima, who called for the probe on extrajudicial killings, and Senator Antonio Trillanes IV.

Trillanes earlier called the report “garbage” and Gordon a “Duterte collaborator.”

Senators Ralph Recto, Joseph Victor Ejercito, and Grace Poe also did not sign the report.

Poe was on official business, while Ejercito is currently serving a suspension order.

The executive summary of the report released Wednesday night said there was no proof of state-sponsored killings.

It noted however that there were “many thousands of killings with impunity” every year in the last two decades.

The report said the committee saw no evidence to prove the existence of the so-called Davao Death Squad despite witness Edgar Matobato’s testimony linking Duterte to killings in Davao City.

FVR, advocates to Duterte: Time running out, implement RH Law

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
Former President Fidel Ramos and other several responsible parenthood advocates on Saturday urged President to intervene in the implementation of the Reproductive Health (RH) Law.

"It is high time to act now. We ask for your intervention to mandate for the full implementation of the RH before time runs out," Ramos and 23 other responsible parenthood advocates said in an open letter to Duterte.

Ramos and the group The Forum for Family Planning and Development Inc. reminded Duterte that he promised the full implementation of the RH Law in his first State of the Nation Address.

"Full implementation of the law will not only safeguard the health and save the lives of thousands of women and children but also reduce poverty and ensure that poor families are able to live a dignified life," the group told Duterte.

Months after former President Benigno Aquino III signed the measure into law, the Supreme Court declared some of its provisions as unconstitutional.

Two temporary restraining orders (TRO) on the implementation of the RH Law has been issued by the high court.

The group told Duterte that the RH Law should be immediately implemented, citing that at least 15 Filipino mother die every day due to pregnancy and childbirth.

"Such act is a blatant disservice to the poor, the very people you vowed to look after and protect. The government must provide free family planning services to those who want it," the RH advocates said in the letter.

VACC to ask Duterte to prevent De Lima from leaving PHL

Unknown 0 4:12:00 PM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
The Volunteers Against Crime and Corruption (VACC) on Saturday said it will try to make a last-ditch effort to prevent Sen. Leila de Lima from leaving the country on Sunday.

"Nananawagan ako sa Presidente na i-revoke ang clearance na 'yan," Lorenzo "Larry" Gadon, legal counsel of the VACC, said in a forum in Quezon City.

Gadon was referring to the allow departure order (ADO) issued by the Department of Justice to De Lima.

VACC chairman Dante Jimenez said in the same forum that De Lima should stay in the country to answer to the charges that they filed against her.

The VACC filed a drug trafficking complaint against De Lima before the Department of Justice over her alleged involvement in the illegal drug trade at the New Bilibid Prison.

The group had also filed a disbarment case against De Lima before the Supreme Court over the senator's alleged illicit affair with her former driver-bodyguard Ronnie Dayan.

Two more disbarment cases have been filed against De Lima by lawyers Agustin Sundiam and Ricardo Rivera.

Gadon said they have learned that De Lima is leaving on Sunday night.

"It's too late. Nalaman namin na she's leaving tomorrow evening, it's Sunday, Wala na kaming magagawa," said Gadon.

De Lima will be out of the country from December 11 to 22.

Gadon said the only legal recourse they have at the moment is to ask the president to revoke the travel clearance as he has the authority to do so.

Allow departure order

Justice Secretary Vitaliano Aguirre II, meanwhile, said that his office has issued an order allowing De Lima to leave the country despite the department's lookout bulletin issued against the senator.

"Acting on the letter of Senator De Lima relative to her plan to travel abroad, the Department of Justice has issued an Allow Departure Order or ADO to allow her to travel abroad because no case has as yet been filed against her before the courts,"

Aguirre said.

GMA News Online had sought Aguirre, De Lima, and the Palace for comment about the appeal of the VACC to Duterte but they have yet to reply as of this posting.

'Rotten' justice system

Jimenez, who became emotional during the forum, said he fears that De Lima might not return to the Philippines if allowed to leave for the US and Germany on Sunday.

Criticizing what he calls the "rotten criminal justice system" in the country, Jimenez said, "powerful people, hindi ko na babanggitin, umalis hindi hinarap ang kaso at nagtago, maraming ganun, alam yan ng ating mga abogado."

"But what happened? Pagbalik nila dito, hinihintay lang nila ang absolution ng mga korte. Ganoon po kabulok ang sistema natin," he added.

Jimenez claimed that De Lima is using her knowledge of the law to delay the cases filed against her.

"She knows the law. Kami wala," he said.

He urged De Lima to face the cases filed against her. "Huwag ka nang umalis if you want to be respected," he said.

Jimenez said they would not have any reason to be concerned about De Lima's travel if she had been appearing in the hearings.

He mentioned that they have another hearing on December 21, but De Lima is scheduled to return to the Philippines on December 22.

In a statement on Friday, De Lima said there was nothing to fear about her scheduled trips abroad.

She promised to return to the country after going to the US to receive an award, and to Berlin, Germany to attend the Annual Conference on Cultural Diplomacy.

Hold departure order

Gadon recalled that during De Lima's time as Justice Secretary, she prevented former President Gloria Macapagal Arroyo from traveling abroad in 2012.

De Lima issued hold departure orders (HDO) against Arroyo pending the filing of plunder and graft charges.

Gadon, who was part of the legal team that defended Arroyo, recalled that De Lima issued the HDO on the basis that the the former president was on the DOJ's Watch List Order (WLO).

He is questioning why De Lima, who is on a WLO herself, was not issued an HDO.

Gadon mentioned that the testimonies during the probes at the Senate and the House of Representatives on the illegal drug trade in the New Bilibid Prison should have been enough to prevent De Lima from leaving the country.

Gadon also noted that one of the countries that De Lima is heading to is Germany, which does not have an extradition treaty with the Philippines.

An extradition treaty allows the transfer of an accused person from one country to another that seeks to put the accused on trial.

Senator Leila de Lima on Friday assured her critics that there is "nothing to worry about" as she prepares to leave for official visits abroad.

In a statement, De Lima, who is the subject of a lookout bulletin issued by the Department of Justice (DOJ), said she is set to receive an award in the United States, and to speak at the Annual Conference on Cultural Diplomacy in Berlin, Germany.

She will abroad from December 11 to 22.

A lookout bulletin directs all immigration officers to closely coordinate with the DOJ and National Bureau of Investigation (NBI) and inform them of any attempt by the subjects to leave the country by forwarding details of their flight, itineraries and/or whereabouts.

De Lima said both visits are "very important" to her as she will speak before "influential world leaders and global thinkers on raising awareness and support for human rights, an advocacy I am passionate about."

De Lima was chair of the Commission on Human Rights and secretary of the DOJ before she was elected senator in the May 2016 elections.

"This is a great opportunity to meet leaders from various fields from around the world and learn from their respective government's initiatives and challenges about cultural diplomacy," she said.

"There is, however, nothing to worry about as I will surely return, along with my staff who will be with me during these foreign visits. I hope my brief absence would provide a welcome relief and respite to my detractors and critics. I will keep them in mind though," De Lima added.

De Lima is the subject of complaints filed by the Volunteers Against Crime and Corruption, former National Bureau of Investigation directors Reynaldo Esmeralda and Ruel Lasala, and convicted kidnapper Jaybee Sebastian.

Last week, she snubbed the preliminary hearing of the DOJ in relation to the complaints filed against her over her alleged involvement in the illegal drug trade.

Malacañang on Friday said that the complaint-affidavit against President Rodrigo Duterte filed at the Office of the Ombudsman was aimed to harass and distract him from doing his work.

Presidential Communications Office (PCO) Asec. Anna Marie Rafael-Banaag in a statement pointed out that the Ombudsman cannot remove an impeachable official such as the President.

"It is noteworthy to mention that the Ombudsman cannot discipline or remove impeachable officials, which include the President. He enjoys immunity while in office," she said.

"The complaint is nothing but harassment aimed at distracting the Chief Executive from performing his duty," she added.

Self-confessed hitman Edgar Matobato filed a complaint anchored on his activities as an alleged member of the Davao Death Squad that Duterte supposedly established during his time as a mayor of Davao City.

But Banaag said that the Ombudsman already dismissed an earlier investigation on the so-called DDS.

"The Ombudsman already terminated an earlier investigation on the Davao Death Squad case which linked then Davao City Mayor Duterte," she said.

Aside from Duterte, Matobato tagged 27 others in his complaint including presidential son and Davao City Vice Mayor Paolo Duterte and Philippine National Police chief Dir. Gen. Ronald "Bato" Dela Rosa.

VACC, ex-NBI officials oppose De Lima bid for DOJ to inhibit from drug raps

Unknown 0 3:24:00 PM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
Two of the four complainants opposed on Friday the bid of Senator Leila De Lima for the Department of Justice (DOJ) to transfer to the Office of the Ombudsman the complaints in relation to her alleged involvement in the Bilibid drug trade.

Complainants Volunteers Against Crime and Corruption (VACC) and former National Bureau of Investigation (NBI) deputy directors Ruel Lasala and Reynaldo Esmeralda said De Lima's motion was against the law and the memorandum of agreement (MOA) between the DOJ and Ombudsman on concurrent jurisdiction on cases involving government officials and employees.

In their joint opposition, the complainants said only the DOJ has the jurisdiction to handle drug cases under the Comprehensive Dangerous Drugs Act (Republic Act 9165).

"It is elementary that jurisdiction is vested by law and not by agreement of the parties. Considering that RA 9165 has vested the handling of cases and preliminary investigation involving violations of the said law to the special prosecutors designated by the DOJ, the Ombudsman has no jurisdiction to handle the preliminary investigation of the instant cases despite the MOA (memorandum of agreement between DOJ and Ombudsman)," the joint opposition stated.

The complainants also rebuffed De Lima's claim of lack of objectivity on the part of Justice Secretary Vitaliano Aguirre II and the five-man panel of prosecutors, calling it a pure "figment" of her imagination.

"Surely, if there is anyone who should be moving for the inhibition of the honorable panel, it should be the complainants," the joint opposition read.

De Lima snubbed the preliminary hearing on December 2. She instead sent her staff, Romeo Siazon, to obtain copies of the complaints.

The senator is accused of tolerating drug syndicates inside the national penitentiary in exchange for campaign funds for the 2016 elections.

De Lima has repeatedly denied the allegations which she called a fabrication by the government. She has been critical of the current administration because of its bloody war on drugs.

Senate committee report flags De Lima, Trillanes for 'unparliamentary conduct'

Unknown 0 3:21:00 PM

<span style="font-family: "arial" , "sans-serif"; font-size: large;">
A Senate committee report said senators Leila de Lima and Antonio Trillanes IV should be held accountable for their alleged "unparliamentary conduct" during the upper assembly's probe on extrajudicial killings (EJKs).

The report was prepared by Senators Richard Gordon and Panfilo Lacson, chairman of the Senate committees on justice and human rights, and public order and dangerous drugs, respectively.

Eleven senators have signed the report but both Trillanes and De Lima did not sign it.

"As elected Senators of the Republic, we must at all times conduct ourselves as honorable men and women observing the highest ethical standards in the performance of our duties," part of the 101-page report said.

Citing the rules of the Senate, the report said "acts and language which offend a senator or any public institution shall be deemed unparliamentary."

The report noted De Lima's supposed deliberate "material concealment" of information concerning a kidnapping case filed against confessed hitman Edgar Matobato.

It also noted that the committee, which De Lima chaired until she was ousted by majority of the senators, was used to "retaliate" against President Rodrigo Duterte after De Lima was dragged into allegations of being involved in the illegal drug trade.

"To defend herself and retaliate against the President, she led the Justice committee to target Duterte and show his propensity for EJK, by presenting and using a lying, inconsistent and unreliable witness," it said.

On Trillanes, the report cited the incident where the senator supposedly allowed Matobato to leave the Senate premises before the hearing was suspended.

Trillanes had been securing the safety of Matobato since the witness appeared before the Senate probe.
"When it was clear that Matobato's failure to reveal the real accused would be cornered with the damaging information presented by the NBI, he was conveniently whisked away," the report said.

After De Lima and Trillanes supposedly apologized to Gordon for their acts, they continued to complain about how the hearing was being conducted before the media.

"All these manifest unparliamentary conduct committed by senators De Lima and Trillanes for which both should be held accountable in order to preserve the integrity of the Senate," it concluded.

The committee report said there was no proof to indicate that the recent rampant killings are state-sponsored.

It also said that the committee did not find any evidence to prove that the so-called Davao Death Squad exists, contrary to Matobato's accusations.
