Drug trafficking charges filed vs. De Lima, 7 others

Anti-crime advocates filed on Tuesday drug trafficking complaints with the Department of Justice (DOJ) against Senator Leila De Lima and seven other personalities allegedly involved in the illegal drug trade inside the New Bilibid Prison.<br /><br />

Apart from De Lima, also charged by the Volunteers Against Crime and Corruption with sale of illegal drugs and conspiracy to commit drug trade under Republic Act 9165 were:<br /><br />

-former Justice Undersecretary Francisco Baraan III;<br />

-former Bureau of Corrections chief Franklin Bucayu;<br />

-De Lima's former security aides Ronnie Dayan, Joenel Sanchez and Jose Adrian Dera alias Jad De Vera; <br />

-Bucayu's staff and alleged bagman Col. Wilfredo Ely; and<br />

-high profile inmate Jaybee Sebastian

Relying on the testimonies of former BuCor officer-in-charge Rafael Ragos and inmate Herbert Colanggo, the VACC said the respondents “acted in concerted effort, whose actions exhibited the display of uniform agreement to engage in illegal drug trade.”<br /><br />

“Each one of them had played significant roles in order to ensure the perpetuation of the illegal drug trade inside the Bilibid,” stated the complaint, which was filed on behalf of VACC by its founding chairman Dante Jimenez.<br /><br />

In De Lima's case, the VACC said she was able to put in position her cohorts at the BuCor to enable her to maneuver the drug trade.<br /><br />

“Her influence and power likewise offered respondents in this case shield and protection to ensure the invinsibility in the conduct of their illegal trade; in this same manner that she was also able to eliminate the competitors of Jaybee inside the prison by having them transferred to the NBI (National Bureau of Investigation) in December 2014,” the complaint stated.<br /><br />

Baraan, on the other hand, according to Colanggo, allegedly earned from facilitating transfer of inmates from one compound to another in return for P500,000, or from one penal colony to another for a higher rate of P3 million.<br /><br />

Ragos had said he delivered P5 million from drug payoffs in two instances to De Lima's house in Parañaque City in late 2012 while Colanggo said the former justice secretary got P3 million monthly from him in exchange for allowing the lavish lifestyle of some high profile inmates.<br /><br />

The complaints, which were prepared by Colanggo's counsel, Ferdinand Topacio, will undergo preliminary investigation by DOJ prosecutors who will determine if there is probable cause to press charges in court.

Later in a statement, De Lima said that while she welcomes the filing of the complaint, she nonetheless wondered by such was filed with the Justice Department.<br /><br />

“The lawyers of VACC and Atty. Topacio should know that such a case against me for acts done while Secretary of Justice should be filed with the Ombudsman,” De Lima said. <br /><br />

She added that while the DOJ may initially take cognizance of the complaint, it would still be eventually filed before the Office of the Ombudsman for another round of fact-finding investigation.<br /><br />

In welcoming the complaint, De Lima said: “Instead of stoning me in a House inquiry, they should start filing cases in the proper venue.”

Building an airtight case against De Lima, however, is not easy, according to Justice Secretary Vitaliano Aguirre II on Monday.<br /><br />

He said they have yet to secure documentary evidence linking the bank deposits amounting to billions of pesos from the illegal transactions to De Lima and suspected drug lords inside the national penitentiary.<br /><br />

Asked why the VACC did not wait for the National Bureau of Investigation (NBI) to complete its fact finding probe into the drug mess, Topacio said it would be better to jumpstart the process of making the respondents accountable.<br /><br />

“We just want to put it under the jurisdiction of the DOJ immediately so that the DOJ can make use of its investigative powers, including the power to subpoena (certain individuals and documents),” he told reporters.<br /><br />

Topacio added not all high profile inmates with drug links were included in the complaints because they were only coerced by Sebastian to take part in the “illegal” fund raising drive for De Lima's senatorial campaign.<br /><br />

“It's very clear na tinakot sila. They were compelled to give money...Tinakot sila. Uniform halos lahat ang sinasabi nila na pag di ka nakisama sa sinasabi ni Secretary De Lima, pag di ka sumunod kay Jaybee Sebastian either ipapalipat ka sa ibang kolonya or sa ibang hindi magandang pasilidad or ipapapatay ka,” he said.<br /><br />

De Lima has repeatedly denied allegations that she had pooled campaign funds from tolerating drug syndicates during her term as justice secretary under the Aquino administration.<br /><br />

The senator believes that she is being politically persecuted due to her decision to spearhead a Senate probe into President Rodrigo Duterte's brutal war on drugs.<br /><br />

Immigration officers have also been directed to keep an eye on De Lima and eight other individuals in the wake of the controversy, which prompted the House of Representatives to hold marathon hearings which ended on Monday evening.<br /><br />

De Lima had snubbed what she called as a “sham inquiry” allegedly aimed at destroying her image in public.

De Lima laments the indifference of the new government to extrajudicial killings and warns that more innocent people will suffer if the killings fail to stop.
On August 17, 2016, the Philippine President Rodrigo Duterte alleged that de Lima had been having an affair with her driver, who Duterte also alleged functioned as De Lima’s collector for drug protection money when she was the Justice Secretary. Duterte also alleged that De Lima’s driver had been using drugs.Duterte later announced that he had in his possession wiretaps and ATM records which confirmed his allegations. He explained that he had received them from an unnamed foreign country. In September 2016, de Lima was removed from her position chairing a Senate committee investigating extrajudicial killings.

Senator Leila de Lima on Friday said the convicted police officer who testified on her alleged links to the prison drug trade is a relative of President Rodrigo Duterte.<br /><br />

Monday, October 10, Senators Vicente Sotto III and Aquilino Pimentel III criticized the French newspaper for their headline "serial killer" to President Rodrigo Duterte.<br /><br />

The Libération newspaper has 4 pages artile entitled "Rodrigo Duterte Le president serial killer" or "Rodrigo Duterte, the serial killer president" in english. <br /><br />

Senate President Pimentel III said that the headline was 'unfair' and there was no clear basis for it. <br /><br />

"That's unfair because did they conduct any in-depth investigative work before they came up with their conclusion? Sana gano'n gawin sa ibang bansa. They should follow the Philippine media – before we make unfair headlines, we have investigated." <br /><br />

"For a French newpaper to label our President as serial killer, ang tanong ko what's their basis? May pinapunta ba sila [na] investigative reporter dito or they just got it from the internet? I don't know what made the editor jump to that hasty conclusion. A serial killing president, what is his evidence?" he added.

Pimentel said that the government cannot control foreign medias and their standards and culture are different from us.<br /><br />
"That's beyond our control. I would not lose sleep over the coverage of the president in foreign media, that's beyond our control. Iba po standards nila doon, kultura nila," Pimentel said.<br /><br />

Eh inunahan na tayo ng isang newspaper, I don't know why they are more knowledgeable about happenings in the Philippines than Filipinos themselves. Siguro, I don't know, maybe the paper needed to sell some issues?" Pimentel said.<br /><br />

For Senator Panfilo Lacson, he said that the headline was "exaggerated" and unfair to blame the President for the deaths linked to illegal drugs. <br /><br />

"I think exaggerated naman ang pag-describe sa kanya na serial killer. Sa akin exaggerated 'yan. Unang-una, hindi naman siguro direct or personal knowledge ang pinanggalingan ng comment ng French newspaper," Lacson said. <br /><br />

"I think it's unfair to tag our president as a serial killer. Maski sinong Pilipino, ke bumoto sa kanya ke hindi, hindi naman maganda pakinggan na inaakusahan na serial killer ang ating pangulo, just because 3,000 suspected drug pushers napapatay, so far," he said.<br /><br />

MANILA – Former President Benigno "Noynoy" Aquino III, former finance secretary Cesar Purisima and executives of oil giant Pilipinas Shell Petroleum Corp. are facing graft charges before the Ombudsman over an alleged P100-billion state revenue losses on wrongfully declared and classified petroleum products.

The complainants, former customs commissioner Napoleon Morales, former customs collector Juan Tan and Batangas-based journalist Lourdes Aclan, claim the government lost about P100 billion after the Aquino administration failed to demand tax payments from Shell. <br /><br />

The subject of the complaint stemmed from the smuggling issue Shell faced in 2010. Shell allegedly skipped tax payments starting 2004 after declaring import entries of unleaded gasoline as "tetrapropylene." The firm had claimed tetrapropylene is not subject to excise tax under the National Internal Revenue Code.<br /><br />

The classification of unleaded gasoline, Catalytic Cracked Gasoline (CCG) and Light Catalytic Cracked Gasoline (LCCG), was also changed from an "exclusively for sale" finished product to a mere "blending component."<br /><br />

Despite this, the Bureau of Customs still demanded P7.348 billion tax payment. Instead of complying, Shell changed the name of the declared gasoline shipment from "CCG" and "LCCG" to "Alkylate," which was classified as non-taxable waste material. Prior this, Shell paid taxes for CCG and LCCG in 2001 to 2004.<br /><br />

The complainants said the P7.348-billion worth of taxes supposedly collected from CCG and LCCG, and P1.9 billion from Alkylate shipments has ballooned to over P100 billion in six years.<br /><br />

They added, Aquino and Purisima snubbed Aclan's letter which called on the administration's attention over the uncollected taxes.<br /><br />

They are complained of violating the "Tariff and Customs Code" and the "Doctrine of Command Responsibility in all Government Offices." Shell has a pending case filed before the Court of Tax Appeals. In the petition, the company asked the tax court to stop the tax collection from previous importations.

Sen. Antonio Trillanes IV, a staunch critic of President Duterte, claimed that his administration has failed on all fronts of governance in its first 100 days.<br /><br />

Trillanes told radio station dwIZ that he does not see anything that could be considered as an achievement by the current administration.<br /><br />

On the economic front, Trillanes said that investors have started to get out of the country, companies have shut down, people are selling Philippine stocks and the peso is weakening.<br /><br />

Trillanes said that a significant part of the jitters is due to the negative statements being made by the President regarding the United States.<br /><br />

He said the administration also failed miserably in its efforts to go after corruption when it paved the way for the release of former president and now Pampanga Rep. Gloria Macapagal-Arroyo who, according to the senator, is the symbol of corruption.

However, he said that this could potentially go downhill with the way the government is dealing with the Communist Party of the Philippines (CPP) in the ongoing peace negotiations.<br /><br />
